Refusal of Care and Transport Protocol
- Medical Direction should be consulted if a patient refuses transportation and it poses a significant risk to the patient or the EMS system/agency.
- In cases of incompetence, treatment and transportation may proceed under "implied consent" or as an incapacitated person.
- If a patient is transported based on implied consent, reasonable measures should be taken to ensure safe transport to the closest appropriate facility.
- Consultation with the physician at the destination facility or the agency’s Medical Director should be considered in high-risk circumstances.
- High-risk circumstances include patients under 18, refusal of care posing significant risk, patients not their own legal guardian, refusal after IV medication, and custody cases.
- Persons in custody can refuse treatment by EMS unless it is life-threatening, but they will be transported to a medical facility under proper supervision.
- If there are questions about a patient's competency or refusal of care, contact Medical Direction for guidance.
- Diabetic patients may sign a Patient Refusal Form under specific conditions, including lucidity, acceptable blood glucose levels, and meeting refusal criteria.
- If there is doubt about the refusal of care or transport of a minor, contact Medical Direction immediately.
- The protocol does not allow more than one refusal on a single EMS Run Report, except for cases where all parties deny injury.
- All measures should be taken to convince the patient to consent, including enlisting the help of family or friends.
- Detailed procedures for determining a patient's ability to refuse care or transport, including documentation and physical assessment, should be followed.
