The Constitution
- The Constitution must be upheld as long as it has not been changed by the sovereign people to prevent the usurpation of power by illegitimate forces.
- The 1987 Constitution is the fourth fundamental law to govern the Philippines since its independence in 1946.
The 1987 Constitution
- It was adopted on February 2, 1987, after a plebiscite in which 76.29% of the electorate voted to ratify it.
- It was created by a Constitutional Commission composed of 50 members appointed by President Corazon C. Aquino.
- The Commission was tasked with framing a new charter to correct the shortcomings of previous constitutions and eliminate vestiges of the past regime.
The Supremacy of the Constitution
- The Constitution is the basic and paramount law to which all other laws must conform.
- All persons, including the highest officials, must defer to the Constitution.
- No act is valid if it conflicts with the Constitution, regardless of its intentions.
- The Constitution must remain supreme, and expediency or greed for power must not undermine its authority.
