Penalties for Violating the Act

The Board has the authority to adopt and promulgate rules and regulations to carry out the provisions of RA 10915, subject to the approval of the Commission.

RA 10915 includes a separability clause which states that if any provision is declared unconstitutional, the remaining provisions shall continue to be in full force and effect.

The incumbent Chairperson and members of the Board shall continue to carry out their functions under the provisions of RA 10915 until a new Board is constituted.

If a corporation or juridical entity violates RA 10915, the penalty of imprisonment shall be imposed on the agricultural and biosystems engineer-in-charge and the responsible professionals.

RA 10915 explicitly states that it repeals all existing laws, decrees, executive orders, and other issuances inconsistent with its provisions.

The rules and regulations adopted by the Board under RA 10915 shall take effect immediately after being promulgated.

The CPD credit units earned by an agricultural and biosystems engineer can be applied as a training requirement for promotion in government agencies and private firms.

The CPD credit units earned by an agricultural and biosystems engineer cannot be accumulated subject to credit transfer under the Philippine Qualification Framework.

It is not the primary duty of the Commission and the Board to effectively implement and enforce the provisions of RA 10915 and its implementing rules and regulations.

The Board is not authorized to file appropriate charges through the concerned prosecution office for violations of RA 10915.

The provisions of RA 10915 can be enforced by all duly constituted law enforcement agencies and offices upon the call or request of the Board or the Commission.

Any person cannot bring cases of illegal practice or violations of RA 10915 before the Commission, Board, or law enforcement agencies.

The Repealing Clause in RA 10915 states that all laws, decrees, orders, and issuances, or portions thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

RA 10915 takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.

The Implementing Rules and Regulations (IRR) for RA 10915 shall be formulated by the Board in consultation with the accredited professional organization of agricultural and biosystems engineers.

The Separability Clause in RA 10915 states that if any provision or part of this Act is declared unconstitutional, the remaining provisions not affected shall continue to be in full force and effect.

The Board under RA 10915 shall be composed of a Chairperson and six (6) members who shall be appointed by the President of the Philippines from a list of nominees submitted by the accredited professional organization of agricultural and biosystems engineers.

Violations of RA 10915 may result in a fine of not less than $50,000 but not more than $250,000, or imprisonment of not less than three (3) months but not more than two (2) years, or both fine and imprisonment.
