The Immigration Rules, also known as HC 395, is a set of regulations that govern immigration to the UK.

The Immigration (European Economic Area) Regulations 2016 apply to citizens of European Economic Area (EEA) countries seeking entry to the UK.

The Start-Up route requires the applicant to have a B1 level of English.

A Certificate of Sponsorship is not required for a non-EEA national studying a degree in the UK.

There is no financial requirement for a Tier 4 student transitioning to the Skilled Worker route.

It is not possible to switch directly to a Religious Worker visa from other routes like Visitor, Partner, or Student.

A Nigerian national seeking entry under the Ancestry rules must have sufficient funds to cover their expenses without working or relying on public funds.

To demonstrate 10 years of continuous lawful residence in the UK, a non-EEA national must meet specific requirements outlined in Appendix Continuous Residence.

In addition to the standard suitability requirements, applicants for entry clearance as an adult dependent relative must also adhere to the general grounds of refusal outlined in paragraphs 9.82 (a) and (c) of Part 9 of the Immigration Rules.

If a client's partner visa application is submitted after their current leave has expired, even if they meet the partner visa requirements, they are considered out of time. They must provide a valid explanation for the delay.

A non-EEA national joining a British partner in the UK needs to have enough savings to meet their financial requirements. If the partner earns a gross annual income of £16,900, the required savings amount is £20,250.

A Jamaican national applying for a partner visa extension does not automatically meet the English language requirements because Jamaica is a majority English speaking country. They will need to either hold a degree or pass an approved English language test.

This visa allows someone to visit the UK for a short period, typically for tourism, business, or family visits.

Vivaan must show he has enough money to support himself during his stay in the UK without needing to work or rely on public funds.

Vivaan needs to prove he has strong ties to his home country in Sri Lanka, demonstrating he will return after his visit.

A British citizen who is living in the UK, and applying to sponsor their child to join them, does not need to be a British citizen themself.

A TB test certificate is required for individuals from specific countries when applying for entry clearance to the UK.

It is not required for a US national living in Nepal applying for a skilled worker Visa.

In order to apply for indefinite leave to remain as the parent of a child in the UK, specific knowledge of language and life requirements must be met. These requirements can be found in Appendix KOLL.

Indefinite Leave to Remain (ILR) is a status that allows an individual to live and work permanently in the UK. A lapse occurs when the grant of ILR expires, usually upon departure from the UK. If ILR is lapsed, re-entry to the UK can be challenging.

A Pakistani national, aged 15, living with relatives in Karachi, can only be sponsored to join his father in the UK if there are compelling circumstances showing his exclusion from the UK is undesirable. His father being the sole provider is not enough because the child is being cared for.

EEA nationals who have lived and worked in the UK for at least 5 years can continue their residence after December 31st, 2020, by applying for and receiving Settled Status.

If an EEA national's application for Pre-settled Status is denied, they can seek an Administrative Review of the decision.

A non-EEA national granted Indefinite Leave to Enter as a parent of a child in the UK can apply for naturalization after 1 year.

A child born outside the UK to a parent who is a British citizen by descent cannot register as a British citizen under any circumstances.

A non-EEA national granted Indefinite Leave to Remain (ILR) can return to the UK without needing a visa, even after leaving for a period.

A child born in the UK to a parent who becomes settled after the child's birth cannot register as a British citizen under the British Nationality Act 1981.

A child born in the UK to a parent with a document certifying permanent residence, will be able to register as a British citizen under the British Nationality Act 1981.

The visa route available to Vivaan is a Visitor visa.

Vivaan must demonstrate that he has sufficient funds to cover the costs of his trip, accommodation, and return travel. He must also have a valid passport with at least 6 months of validity remaining.

Vivaan has a strong case based on his previous travel history, financial stability, and the purpose of his visit being related to a close family member's wedding. However, the short duration of his previous visit and his wife's passing may raise concerns.

Vivaan should provide his passport, his bank statements, his travel itinerary (including flight bookings), an invitation letter from Sachini, and evidence of Sachini's British citizenship.

Vivaan needs to complete an online application form, pay the application fee, and book an appointment at a visa application center to provide his biometrics (fingerprints and photograph).
