Contractor Obligations and Responsibilities
- Operation and maintenance manuals must be prepared by the Contractor as per the Specification.
- The completion of the works for taking over is subject to the Engineer's review and acceptance of the operation and maintenance manuals.
- If specified in the Specification, the Contractor is required to carry out training for the Employer’s employees and identified personnel in the operation and maintenance of the Works.
- Training timing and requirements are to be in accordance with the Specification or as acceptable to the Employer.
- The Contractor must provide qualified training staff, facilities, and materials as necessary.
- Co-operation with the Employer’s personnel, other contractors, and public authorities is required from the Contractor as stated in the Specification or instructed by the Engineer.
- The Contractor is responsible for coordinating activities with other contractors and allowing opportunities for work by others on or near the site.
- The Contractor is entitled to an extension of time and/or payment of costs plus profit if cooperation, allowance of opportunities, and coordination were unforeseeable and led to delay or incurred costs.
- The Contractor is responsible for setting out the Works in relation to the specified items of reference and ensuring accuracy.
- If the Contractor finds an error in the items of reference, they must notify the Engineer and rectify the error within the specified period or as soon as practicable after receiving the items of reference.
- The date of commencement of the time limit for agreement under Sub-Clause 3.7.3 is defined by the date the Engineer receives the Contractor’s Notice under Sub-Clause 4.7.2 [Errors].
