Cooperative Acquisition and Logistics Support Agreements with NATO Countries

• The Secretary of Defense can enter into bilateral or multilateral agreements with NATO countries to provide cooperative acquisition and logistics support for armed forces.
• These agreements are known as Support or Procurement Partnership Agreements and are made with countries participating in the NATO Support and Procurement Organization.
• The agreements are entered into under the terms of the NATO Support and Procurement Organization's charter and provide for common acquisition and logistics support of activities common to participating countries.

Agreement Provisions

• Agreements can provide for the transfer of logistics support, supplies, and services by the US to the NATO Support and Procurement Organization.
• Agreements can also provide for the acquisition of armaments and logistics support, supplies, and services by the US from the NATO Support and Procurement Organization.

Authority of the Secretary of Defense

• Under the terms of a Support or Procurement Partnership Agreement, the Secretary of Defense can agree to allow the NATO Support and Procurement Organization to enter into contracts for supply, services, support, and acquisition, including armaments, for US requirements.
• The Secretary of Defense can share the costs of setting up facilities and establishing a revolving fund for initial acquisition and replenishment of supply stocks with the NATO Support and Procurement Organization.

Cost Sharing and Management

• Each Support or Procurement Partnership Agreement provides for joint management by participating countries and equitable sharing of administrative costs and costs of claims.
• The agreements provide for joint management and cost sharing to ensure equitable distribution of costs and benefits among participating countries.

Application of Other Laws and Regulations

• Except as otherwise provided, the provisions of chapter 137 of this title apply to contracts entered into by the Secretary of Defense for the acquisition of logistics support under a Support or Procurement Partnership Agreement.
• Any transfer of defense articles or defense services to a NATO country or the NATO Support and Procurement Organization must be carried out in accordance with this chapter and the Arms Export Control Act.
