Mobile Identification (Mobile ID)
- Mobile ID is a portable device for law enforcement to identify individuals.
- Databases searched: Bexar County, Texas Department of Public Safety (DPS), and Federal Bureau of Investigation (FBI/RISC) Repository of Individuals of Special Concern.
- Bexar County database is searched first. If no match, the transaction moves to DPS, then FBI/RISC.
- Response times:
- Bexar County: 45 seconds
- DPS: 30 seconds
- FBI/RISC: 60 seconds
- Response times do not include wireless transmission time between device and AFIS databases.
- Bexar County response includes CJIS SID and photograph if available.
- DPS response: Hit, No-Hit, or Inconclusive along with DPS number.
- FBI/RISC response is the same as DPS.
Definitions
- Bexar County Automated Fingerprint Identification System (AFIS) is a computerized biometric matching system.
- Currently contains 450,000 fingerprint records.
- Texas Department of Public Safety's AFIS contains over 8 million records.
Consent for Use
- Mobile ID can be used if the subject gives knowing and voluntary consent.
- Consent can be withdrawn at any time.
- Mobile ID can be used without consent:
- Upon arrest
- If authorized by a valid search warrant
- If specifically required by statute.
Authorized Use
- Prior to arrest/detention, Mobile ID can be used with consent if:
- Deputy has reasonable suspicion of a crime and believes the scan will establish or contradict the subject's connection to the event.
- Deputy has reasonable suspicion the subject is wanted on an arrest warrant and the scan would establish or nullify the subject's identity.
- Deputy is citing a subject for a traffic violation or misdemeanor and reasonably suspects false information.
- Deputy has reasonable suspicion the subject is a witness to a crime and reasonably suspects false information.
Non-Standard Use
- Non-standard use requires notification and authorization from the deputy's supervisor.
- Examples include requests from outside agencies to fingerprint subjects in custody.
Unauthorized Use
- Mobile ID may not be used for random or general investigations or intelligence gathering.
- Deputies must comply with all established Sheriff’s Office policies.
- Unauthorized use may result in disciplinary action.
