Mobile AFIS Device Usage Policy
- Mobile AFIS devices scan index fingerprints to identify individuals at crime scenes, disasters, or other locations needing rapid identification.
- Devices scan fingerprints and submit them to Nebraska State AFIS and FBI RISC databases.
- Search results are returned within 30 seconds.
- The Omaha Police Department (OPD) uses mobile AFIS in conjunction with the Nebraska State Patrol (NSP).
- Results are investigative leads only, based on fingerprint quality.
- Information from a hit does NOT imply a criminal record or warrant.
Mobile AFIS Device Definitions
- Hit: Positive identification via fingerprints in AFIS or RISC database.
- Mobile AFIS Device: Handheld device scanning fingerprints and submitting them to databases via the Mobile Data Computer (MDC) or OPD desktop.
- Mobile AFIS Program: Nebraska State Patrol's program enabling mobile fingerprint searches of the Nebraska AFIS and FBI RISC databases.
- Nebraska AFIS Database: Contains fingerprints and demographics (name, sex, date of birth, SID number).
- RISC Database: FBI database containing fingerprints and limited demographic information (name, place/county of birth, FBI/UCN) of known or suspected individuals (terrorists, sex offenders, etc.).
Mobile AFIS Procedures
- Responsibilities: Chief/designee approves devices and criteria for operators.
- UPB Sergeants: Ensure officer training, problem reporting, device maintenance and FBI reporting on hits.
- Improper Profiling: Use of devices should not appear to profile.
- General Procedures: Training mandatory for device use. Device checked out for shifts only. Other OPD fingerprint policies apply.
- Consent: Voluntary consent required for scanning. Consent can be withdrawn. No coercion allowed.
- Specific Use Cases: Identification of the deceased/incapacitated, establishing identity when official ID is absent, assisting with medical history requests, notification of next-of-kin. Traditional fingerprinting remains required for official records.
- Prohibited Use: Random or general intelligence gathering not authorized.
- Reasonable Suspicion: Reasonable suspicion needed before bringing someone to headquarters for device use. The purpose is immediate identification to establish or eliminate involvement in a crime.
- Identification Failure: If identification fails, capture fingerprints or use other methods.
- Officers' Justification: Officers must justify Mobile AFIS use based on training and circumstances.
- FBI Hit Reporting: Five questions required for FBI hits; pdf reports created and automatically emailed to the AFIS administrator.
Mobile AFIS Retention
- Devices store up to five cases; cases are deleted as new cases are captured.
- Criminal history is NOT stored on the device. Biometric information cannot be used without the software.
- Procedures for the archiving of Mobile AFIS related results are set out in this policy document.
Mobile AFIS Training
- Training is conducted using a Train-the-Trainer model, initially provided by NSP.
- Users gain practical experience and system knowledge via hands-on transactions.
- OPD trainers receive updated materials from NSP for continued training of users.
