Regional Tripartite Wages and Productivity Boards (RTWPBs)
- Prescribe minimum wage rates for industries per location
- Consider the number of workers and enterprise capitalization
Wage Orders
- Wage increases stipulated apply to private sector workers and those earning minimum wage
- Example: Daily minimum wage in NCR is 500-537 pesos; Region IV A (non-agriculture) is 317-400 pesos
Minimum Wage
- Based on a normal 8-hour workday
- Excludes Barangay Micro Business Enterprises (BMBEs) with total assets under 3 million pesos
- All BMBEs employees are still entitled to benefits like SSS and Healthcare
- Workers paid by results must be paid at least the minimum wage rate for an 8-hour workday
- Apprentices and Learners must be paid at least 75% of the applicable minimum wage
- Persons with Disabilities are eligible for the same terms, conditions, benefits, and compensation as able-bodied individuals
Income Tax Exemption
- Individuals with an annual gross compensation below 250,000 pesos are exempt from income tax
Holiday Pay
- Paid at the regular daily wage for any unworked regular holiday
- Not granted to:
- Government Employees
- Retail/Service establishments with less than 10 workers
- Kasambahay and personal service workers
- Managerial employees
- Officers or members of the managerial staff
Service Incentive Leave
- Unused leave can be converted to its monetary equivalent at the end of the year
Maternity Leave
- 105 days with full pay for all private sector female employees
- Additional 15 days with full pay for solo parents
- 60 days with full pay for miscarriage or emergency termination of pregnancy
- 30 days unpaid leave can be availed after live childbirth
Paternity Leave
- 7 calendar days with full pay for married male employees in the private sector
- Applicable for the first 4 deliveries of the employee's lawful wife
- Aimed to offer support to their wives during recovery
- Not convertible to cash if not availed
Parental Leave for Solo Parents
- 7 work days every year for solo parents
- Non-convertible to cash if not availed
- Available to:
- Individuals taking on parenthood due to rape, death of spouse, spouse's detention/sentencing
- Spouse's physical/mental incapacity, legal separation, nullity/annulment of marriage, spouse's abandonment
- Unmarried mothers/fathers, those solely providing parental care, family members assuming head of family responsibility
Leave for Violence Against Women and Children
- Paid leave benefit for private sector women employees who are victims as defined in RA 9262
- Covers days for medical and legal concerns
- Requires certification from a Barangay official, prosecutor, or court clerk
- Entitles victim-employees to 10 days of leave with full pay
Special Leave for Women
- 2 months of leave with full pay for female employees undergoing surgery related to gynecological disorders
- Granted after surgery
13th Month Pay
- Minimum of 1/12 of the total basic salary earned during the year
- Paid not later than December 24th
- Applicable to workers paid on a piecework basis and those with a fixed wage plus commission
- Partial 13th month pay is granted to employees working less than 12 months
Separation Pay
- Half a month's pay for every year of service, with 6 months considered a year
- Granted for:
- Retrenchment to prevent losses
- Closure or cessation of operation
- Employee suffering from an incurable illness (within 6 months)
- Lack of service assignment for security guards (continuous 6 months)
- Notice of termination is required one month prior
- Not provided for termination due to just cause
Retirement Pay
- Compulsory retirement age is 60 years old; 65 years old is compulsory
- Minimum of ½ month salary for every year of service
- Eligibility requires at least 5 years of service
- For underground mining employees: Compulsory retirement age is 60 years old; 50 years old with at least 5 years of service
- Racehorse jockeys: Compulsory retirement age is 55 years old; must be licensed by PHILRACOM
- Kasambahay and personal service workers are also eligible

Disability Benefits
- Temporary Total Disability: Unable to work for a continuous period not exceeding 120 days

- Loss of both limbs at or above the ankles or wrists
- Permanent complete paralysis of both limbs
- Brain injury causing incurable imbecility or insanity
Claims for Employees' Compensation Program
- Only for work-connected sickness, injuries, or death
- Must be filed within 3 years from:
- Sickness: When earning capacity is lost
- Injury: From the time of injury
- Death: From the time of death

- Contribute to the State Insurance Fund in behalf of employees
