Mechanics Liens in Wyoming
- Governed by Title 29 of the Wyoming Statutes
- Both general contractors and subcontractors have lien rights
- Material men, engineers, architects, and design professionals also have lien rights
- Deadline to file a lien varies depending on the project participant
- General contractors: 150 days from the date labor or materials were provided or 150 days from project completion (whichever is earlier)
- Other participants: 120 days from the date labor or materials were provided or 120 days from project completion
- Two preliminary notices required for all project participants:
- Preliminary Notice of Right to Lien: Must be filed with the property owner
- Notice of Intent to Lien: Must be sent 20 days before filing a lien
- Failure to submit these notices on time will forfeit lien rights
- General contractors must provide preliminary notices before receiving any payment
- Subcontractors and suppliers have 30 days after first providing labor or materials to submit preliminary notices
- Notice of Intent to Lien must be sent within 20 days of filing the lien
- All preliminary notices must be sent to the property owner via certified mail with return receipt requested
- Priority of liens depends on timing
- Preexisting mortgages or encumbrances take priority over subsequently filed liens
- Mechanics liens filed before subsequent mortgages or encumbrances will take priority
- All mechanics liens relate back to the date construction first commenced on the project for timing determinations
