Study Notes

Pre-Disciplinary Determination Hearing

  • If disciplinary action is deemed necessary after an investigation, the affected employee may accept the discipline and sign a waiver or appear at a Pre-Disciplinary Determination Hearing.
  • Recommendations for termination will be heard in person by the Sheriff.
  • If the Sheriff is absent, the Chief Deputy or another representative may be appointed.

Career Service Appeal Board Suspension

  • If the maximum punishment is greater than suspension without pay in excess of 43 hours or payment of property damage, the affected employee shall abide by the provisions of the Career Service Appeals Board.
  • The Board will hear appeals of permanent status employees arising from personnel actions.
  • The decision of the CSAB is final and binding on the employee and the Sheriff.

Domestic Violence

  • Matters shall be referred to Professional Standards for review.
  • Temporary injunctions will be reviewed by Internal Affairs to determine if the employee needs to turn in their firearms and ammunition.

  • Certain vulnerable groups, such as children, the elderly, and the mentally or physically challenged, are considered in danger any time they are missing.

Amber Plan and Silver Alert

  • The Amber Plan is a program designed to broadcast critical information of a missing/abducted child believed to be in danger.
  • The Silver Alert is a statewide plan to aid local law enforcement in the rescue or recovery of a missing elderly person who suffers from irreversible deterioration of intellectual faculties.### Levi's Call Activation
  • A detailed description of the child, abductor, and/or vehicle information is required to broadcast to the public.
  • The activation must be recommended by the law enforcement agency or jurisdiction.
  • The goal is to activate the broadcast within 30 minutes of receipt of the information.
  • Activation can only be done through FDLE's Missing Endangered Person Information Clearinghouse.

Child Abduction Response Team (CART)

  • CART is a special investigation function of the FDLE.
  • It investigates the abduction or endangerment of children in the Southwest Florida area.
  • To initiate a request for assistance, the Sheriff/Chief Deputy must contact FDLE Fort Myers Region CART SAC.

Silver Alert

  • The Silver Alert System should be activated as soon as possible after it is determined that all of the criteria have been met.
  • The missing person must be 60 years of age or older and have a diagnosed cognitive impairment, such as dementia.
  • Alternatively, the missing person can be between 18 to 59 years old with irreversible deterioration of intellectual faculties.
  • Authorization to activate the Florida Silver Alert Plan must be obtained from the PATROL SHIFT LIEUTENANT OR CID.

Initial Searches

  • The initial search area should be the immediate area (house, yard, neighborhood) near the last known location of the missing person.
  • The search should be methodical, systematic, and thorough.
  • The search area should be expanded to a five to ten square block area if the victim is not found near the location where last seen.

Requesting Additional Resources

  • If the missing person is not located during the initial search, the Captain/Designee shall decide whether to summon additional ground and aerial resources.
  • Assistance can be requested from groups and agencies.

FCIC/NCIC

  • FSS requires entry into FCIC/NCIC within 2 hours after receipt of the report.
  • Only the originating agency can make the FCIC/NCIC entry.

Investigative Follow Up

  • The Investigative Bureau is responsible for following up on reports of missing persons.
  • State statute requires a monthly review of each case and a determination of whether the case should be maintained in the FCIC/NCIC database.

DNA Collection

  • DNA can be collected for three different categories associated with Missing Persons' Cases: Direct Reference Samples (DRS), Family Reference Samples (FRS), and Unidentified Human Remains Samples (UHR).

ON-VIEW Verification

  • Verification of a person's return and well-being is required in all cases reported to MCSO when the missing person is:
    • A juvenile under 13 years of age
    • A juvenile 13-17 years of age and is a first-time runaway
    • A vulnerable adult (elderly with Alzheimer's, disabled, etc.)
    • Of any age, and was missing involuntarily and/or under circumstances of suspected or known foul play

Media Alert Criteria

  • The age of the child (higher priority given if under 13 years of age)
  • The mental maturity of the child (mentally disabled at higher risk)
  • The medical condition of the child (needs injection/medication)
  • If the child has no prior history of running away
  • If the parent/guardian believes the child to be in danger, even if the child is with a biological parent, or has gone with someone willingly
