- The landlord leases the premises to the tenant in terms of the lease agreement.
- The duration of the lease agreement can be less or more than 24 months.
- If the tenant cannot occupy the premises on the effective date due to certain circumstances, the landlord will not be liable for any damages suffered by the tenant.
- The lease agreement will continue on a month-to-month basis after the initial period, unless either party advises the other in writing at least 30 days prior to the termination of the initial period.
- The lease agreement can be extended on the same terms for a further fixed-term period, or the parties can sign a new lease agreement.
- If the parties fail to agree on the terms of the extension or the new lease agreement, the lease agreement will continue on a month-to-month basis.
- Either party can terminate the lease agreement without reason or penalty on a month-to-month basis by giving a calendar month's written notice.
- The provisions of Section 14 of the CPA will no longer apply to the lease agreement if it continues on a month-to-month basis.
- The tenant will have the financial benefit of the items set out in item 1.25 if the duration of the lease agreement is more than 24 months.
- The lease agreement will terminate on the date set out in item 1.24, unless cancelled or terminated earlier in accordance with its terms.
