NRS 289.010 Definitions
- Administrative file: Any file of a peace officer containing information, comments, or documents about the officer. Excludes files related to investigations under NRS 289.057 or criminal investigations of an officer.
- Adult use of cannabis: Defined in NRS 678A.075.
- Law enforcement agency: Any agency, office, bureau, department, unit, or division created by statute, ordinance, or rule that has a duty to enforce the law and employs peace officers under NRS 289.150 to 289.360.
- Medical use of cannabis: Defined in NRS 678A.215.
- Peace officer: Any person with some or all of the powers of a peace officer conferred by NRS 289.150 to 289.360.
- Punitive action: Actions (dismissal, demotion, suspension, salary reduction, written reprimand or transfer) taken as punishment for a peace officer.
- Screening test: A test of blood, urine, hair, or saliva to detect controlled substances.
NRS 289.020 Punitive Action Prohibited
- Law enforcement agencies cannot take punitive action against a peace officer if the officer exercises internal administrative grievance procedures.
- If a peace officer is denied a promotion or other punitive action is taken, the agency must provide a hearing.
- If a peace officer requests representation during questioning by a superior officer, questioning immediately ceases.
- Refusal to cooperate in a criminal investigation may result in insubordination charges.
NRS 289.025 Confidentiality of Home Address and Photograph
- Home address and photographs of peace officers are confidential within the law enforcement agency, except in the following cases:
- If the officer authorizes the release,
- If the officer has been arrested,
- If the information is included in a 911 report, police report, witness statement, or a report detailing the placement of a child under NRS 432B.540.
NRS 289.030 Cannabis Disclosure before Employment
- Law enforcement agencies cannot require peace officers to disclose financial information, assets, debts, or sources of income, or to provide attestation for prior cannabis use (with exceptions for certain requirements to determine credentials for transfer to a specialized unit, prevent conflict of interest, or determine if engaged in unlawful activity).
NRS 289.027 Service of Subpoenas on Peace Officers
- Each law enforcement agency must adopt policies for the orderly and safe service of subpoenas on their peace officers.

- NRS 289.035: Agencies cannot mandate a certain number of traffic citations or arrests.
- NRS 289.040: Unfavorable comments or documents in officer files are prohibited unless the officer has initialed the document or the agency notes the refusal to initial.

- NRS 289.085: Enforcement agencies cannot keep or make records of investigations or punitive action relating to officers, except complaints or accusations filed with the agency more than 5 years after the behavior occurred, and cannot impose suspension without pay until after the investigation is concluded.
- NRS 289.090: Certain provisions do not apply to investigations that concern alleged criminal activities.
- NRS 289.092: Peace officers who are suspended cannot receive back pay pending criminal prosecution, unless those charges are dismissed, the peace officer is found not guilty, or not subjected to any corrective action.
