Arrest Procedure for Misdemeanors

  • The purpose of this standard operating procedure is to define guidelines for making a physical arrest or issuing a Notice to Appear (NTA) for misdemeanor offenses committed by adults.

Scope

  • This procedure applies to all sworn Sheriff's Office personnel.

Discussion

  • The Sheriff's Office conforms with the legislative intent in the issuance of the "Notice to Appear" (NTA) summons in lieu of arrest.
  • Persons arrested for misdemeanors of the first or second degree, county ordinance violations, or criminal traffic offenses are to be released at the scene of arrest upon execution of a promise to appear in court rather than be booked into the county jail.

Procedure

  • Prior to issuing an NTA, the arresting deputy must identify if the arrestee qualifies for the Adult Pre-Arrest Diversion Program (APAD).
  • If the arrestee does not qualify for APAD, the arresting deputy will follow guidelines for issuing an NTA.
  • Persons who refuse to sign an NTA or fail to provide sufficient information for an NTA shall be arrested, transported, and booked in the county jail.

Exceptions to NTA

  • The following exceptions apply:
  • The subject is a known habitual offender.
  • The offense committed is of a violent nature.
  • The deputy has reason to believe that the accused will repeat the offense if continued at liberty.
  • The accused exhibits violent or disorderly behavior.
  • The accused resides in a non-adjoining county or out of state.
  • The accused has no valid address.
  • The liberty of the accused person presents an unreasonable risk of bodily injury to himself/herself or others.
  • The accused person has no ties to the jurisdiction reasonably sufficient to ensure appearance in court, or there is a substantial risk the accused person will refuse to respond to the notice.
  • The arresting deputy has reason to suspect that the accused person may be wanted in another jurisdiction.
  • It appears that the accused person has previously failed to respond to a notice or summons, or has violated the conditions of a pre-trial release program.

Capias and ROR

  • If a deputy encounters an individual with an active capias for an unserved summons, the deputy shall take the individual into custody and transport the person to Central Booking.
  • Personnel shall not issue an NTA in lieu of Releasing on Recognizance (ROR) for a capias on an unserved summons.

Traffic Citations

  • Florida Law prescribes the manner in which persons who commit a traffic infraction are to be cited.
  • A person cited for a criminal traffic offense under Florida Statute 316, or any other traffic offense that requires a mandatory court appearance, must sign and accept the citation indicating a promise to appear.

Release of Signature

  • If the arresting deputy plans to release the defendant after securing a signature on an NTA or the criminal traffic citation, the following procedure shall be followed:
  • Deputies shall utilize the NTA Fingerprint Card when issuing an NTA as a means to collect the defendant's fingerprints.
  • Deputies shall complete the front portion of the card listing incident type, case number, defendant information, and the arresting deputy's information.
  • Deputies shall utilize the reverse side of the card to print the four fingers on the defendant's right hand (index, middle, ring, and little) utilizing the existing fingerprint ink pad.
  • Deputies shall take a digital photograph of the defendant for upload into the Veripic system and attach same to the entity in the MRE.

Booking Personnel

  • When an accused person is received at Central Booking for a misdemeanor, the Booking supervisor may issue an NTA ensuring the above procedure is followed.
  • The Booking supervisor shall determine whether the accused person is likely to appear based on:
  • Residence and length of residence in the community.
  • Family ties in the community.
  • Employment record.
  • Character and mental condition.
  • Past record of convictions.
  • Past history of appearance at court proceedings.
  • Positive identification.

Victim Services and Support

  • The Sheriff's Office provides victim services and support through the Victim Specialist Program, which is part of the Behavioral Resources Unit (BRU).
  • The program provides 24-hour assistance to victims and witnesses of serious crimes.
  • The Victim Specialist is a civilian employee trained to provide support and services to victims and witnesses.

Definitions
