Project workers are directly employed by the project, contracted through third parties for core project functions, employees of primary suppliers, and community laborers. ESS2 applies to all types of workers involving the project (full-time, part-time, temporary, seasonal, migrant). Government civil servants are exempt unless their employment is explicitly transferred to the project. Specific provisions (paragraphs 17-20, 24-30) about worker protection and safety still apply in these cases. Contracts must include relevant requirements and non-compliance remedies. Contracts with third parties must include equivalent requirements and non-compliance remedies.

  • Subcontracting: Procedures ensure compliance from subcontractors. Borrowers will require that third parties include equivalent requirements and non-compliance remedies in their contractual agreements with subcontractors, including provisions for non-compliance remedies.

Child Labor and Minimum Age

  • Child Labor: No child under the established minimum age (14 or as dictated by national law) may be employed. Children aged under 18 may only be employed in specific, non-hazardous tasks that do not harm their health or impede their education and do not violate national laws. Risk assessments and related monitoring are mandatory.

  • Grievance Mechanisms: These mechanisms must be proportionate to the project's scale and risks. They must be readily accessible, transparent, address worker issues promptly and avoid worker retaliation; should prevent unnecessary delays, and provide detailed feedback. Contracted and Community Workers

Borrowers must include relevant requirements and remedies for non-compliance in contracts. If contracted workers don't have a grievance mechanism, Borrowers must provide access through the Borrower's procedure (Section C, ESS2).
  • Community Workers: Projects utilizing community labor (e.g., food-for-work, community development projects) must adapt ESS2 implementation proportionally, considering project nature, scope, and worker involvement. Procedures must ascertain if work is voluntary and addresses relevant potential impacts and risks. Specific considerations include the nature and scope of the project, the activities, and the potential risks to the community workers. The relevant provisions of ESS2 (from paragraphs 9 to 15 and 24-30) are to be assessed in relation to community work.
  • Primary Supply Workers: Procedures are required to address potential risks related to child labor, forced labor, and significant safety issues with primary suppliers. Suppliers must meet ESS2 standards where relevant. Procedures and remedies are needed including clear roles, responsibilities for monitoring primary suppliers, and appropriate measures for addressing any identified instances of child labor, forced labor or serious safety issues. Shift to more compliant suppliers if necessary.
  • Special measures of protection: Measures to protect vulnerable workers (women, people with disabilities, migrant workers, and children) might be necessary; duration should depend on the specifics of each situation.
  • Worker Accommodation: If accommodation is provided, procedures for management and quality must protect and promote the health, safety, and well-being of workers, addressing physical, social, and cultural needs.
  • Grievance mechanisms for Community Workers: Procedures must be in place for community workers to voice workplace concerns; procedures must consider the context of the project.
