    Study Notes

    Labor and Working Conditions

    • Introduction: Employment creation and income generation are important for poverty reduction and inclusive economic growth. Borrowers should foster positive worker-management relations, ensuring safe and healthy working conditions for project workers.
    • Scope of Application: Applicability of ESS2 is determined during ESS1.2 environmental and social assessment. Project workers are directly employed by the project, contracted through third parties for core project functions, employees of primary suppliers, and community laborers. ESS2 applies to all types of workers involving the project (full-time, part-time, temporary, seasonal, migrant). Government civil servants are exempt unless their employment is explicitly transferred to the project. Specific provisions (paragraphs 17-20, 24-30) about worker protection and safety still apply in these cases. Contracts must include relevant requirements and non-compliance remedies. Contracts with third parties must include equivalent requirements and non-compliance remedies.
    • Core Functions: Are essential production and/or service processes integral to the project.
    • Primary Suppliers: Ongoing suppliers directly providing essential goods or materials needed for the project's essential functions.
    • Third Parties: This may include contractors, subcontractors, brokers, agents, or intermediaries.
      • Third parties must fulfill equivalent requirements and non-compliance remedies as in the borrower/subcontractor contracts.
      • Third parties must include equivalent requirements for non-compliance remedies in their contractual agreements with subcontractors. -Contracted workers will have access to a grievance mechanism. If the third-party employer can't provide a mechanism, the Borrower will ensure access through the Borrower's procedure (Section C, ESS2).

    Objectives

    • Safety and Health: Promote safe and healthy work environments.
    • Fair Treatment: Ensure fair treatment, non-discrimination, and equal opportunities for all project workers, including vulnerable groups (women, people with disabilities, children, migrant workers).
    • Forced Labor: Prohibit all forms of forced labor and child labor.
    • Freedom of Association: Support freedom of association and collective bargaining rights for project workers, consistent with national law.
    • Workplace Concerns: Facilitate accessible methods for workers to address workplace concerns.
    • Worker Rights: Workers' rights regarding working conditions and employment terms should be protected. Workers should not be discriminated against or retaliated against for participating in worker organizations or negotiations.
    • Information and Documentation: Project workers must receive clear and understandable information regarding their employment terms and conditions, including rights under national labor and employment laws, and collective agreements (including wages, overtime, etc.). This must be provided at the beginning of employment and as needed during employment.

    Labor Management Procedures

    • Worker Relations: Procedures must outline management of worker relationships across all worker categories including direct workers and those managed by third parties; details how worker rights (wages, overtime, and benefits) will be handled, complying with national law and the ESS2 requirements. Written procedures are required covering the specifics. Terms, conditions, and changes must be clearly documented. Written procedures should also include an understandable process for handling grievances with clear language. Procedures must be proportionate to the project.
    • Grievance Mechanisms: Procedures must be proportionate to the project's scale and risks. They must be readily accessible, transparent, address worker issues promptly and avoid worker retaliation; should prevent unnecessary delays, and provide detailed feedback. Existing mechanisms can be used or supplemented. Information should include payment of wages.
    • Subcontracting: Procedures ensure compliance from subcontractors. Borrowers will require that third parties include equivalent requirements and non-compliance remedies in their contractual agreements with subcontractors, including provisions for non-compliance remedies.

    Child Labor and Minimum Age

    • Child Labor: No child under the established minimum age (14 or as dictated by national law) may be employed. Children aged under 18 may only be employed in specific, non-hazardous tasks that do not harm their health or impede their education and do not violate national laws. Risk assessments and related monitoring are mandatory.
    • Hazardous work: Children under 18 must not be engaged in hazardous work including dangerous machinery, working underground, at heights or in confined spaces; exposure to hazardous substances; or excessive work hours or detrimental environmental conditions.

    Protecting the Workforce

    • Forced Labor: Forced labor, in any form — including involuntary work, work with threat or penalty, coercion, abduction, fraud, or other forms of exploitation — is prohibited and trafficking in persons (recruitment, transportation, transfer, harboring, or receipt of persons using coercion, abduction etc., for exploitation) is not permitted. This applies to direct, contracted, and community workers.
    • Occupational Health and Safety: Comprehensive OHS measures must be implemented, taking into account general and industry standards. Measures must include hazard identification, prevention & protection, training and documentation, including reporting of accidents, diseases, and incidents. Clear processes for workplace safety must be in place, including measures concerning chemical, physical, and biological risks. Procedures for handling emergencies, including arrangements for emergency prevention, preparedness, and response, are required. The implementation must include clear guidelines and remedies for impacts, including accidents, deaths, disabilities, and diseases.
    • Worker Well-being: Workers must have access to appropriate facilities (canteens, hygiene facilities, rest areas) and accommodation (if applicable) aligned with workers' health, safety, and well-being, with consideration for physical, social, and cultural needs.
    • Grievance Mechanisms: These mechanisms must be proportionate to the project's scale and risks. They must be readily accessible, transparent, address worker issues promptly and avoid worker retaliation; should prevent unnecessary delays, and provide detailed feedback. Existing mechanisms can be used or supplemented.
    • Payment: Project workers must be paid regularly, and deductions will only be allowed as permitted by national law or labor management procedures. Project workers must be informed about these conditions.

    Contracted and Community Workers

    • Contracted Workers: Third-party contractors must have labor management procedures complying with ESS2 and readily accessible grievance mechanisms. Borrowers must include relevant requirements and remedies for non-compliance in contracts. If contracted workers don't have a grievance mechanism, Borrowers must provide access through the Borrower's procedure (Section C, ESS2).
    • Community Workers: Projects utilizing community labor (e.g., food-for-work, community development projects) must adapt ESS2 implementation proportionally, considering project nature, scope, and worker involvement. Procedures must ascertain if work is voluntary and addresses relevant potential impacts and risks. Specific considerations include the nature and scope of the project, the activities, and the potential risks to the community workers. The relevant provisions of ESS2 (from paragraphs 9 to 15 and 24-30) are to be assessed in relation to community work.
    • Primary Supply Workers: Procedures are required to address potential risks related to child labor, forced labor, and significant safety issues with primary suppliers. Suppliers must meet ESS2 standards where relevant. Procedures and remedies are needed including clear roles, responsibilities for monitoring primary suppliers, and appropriate measures for addressing any identified instances of child labor, forced labor or serious safety issues. Shift to more compliant suppliers if necessary.
    • Special measures of protection: Measures to protect vulnerable workers (women, people with disabilities, migrant workers, and children) might be necessary; duration should depend on the specifics of each situation.
    • Worker Accommodation: If accommodation is provided, procedures for management and quality must protect and promote the health, safety, and well-being of workers, addressing physical, social, and cultural needs.
    • Grievance mechanisms for Community Workers: Procedures must be in place for community workers to voice workplace concerns; procedures must consider the context of the project.
