Kansas City Police Department: Arrest Procedures - Possession of Controlled Substance
- Officers must follow specific procedures when suspected controlled substances are recovered, as outlined in the Procedural Instruction 13-6.
- A controlled substance is any drug, substance, or immediate precursor listed in Section 195.017 of the Missouri Revised Statutes.
- Possession of controlled substance charges are pursued only after a lawful arrest, search, or seizure.
- All substances will be documented in accordance with the "Tiburon Computer System – Automated Reporting System (ARS) / Records Management System (RMS)" and recovered as outlined in "Recovered Property Procedure".
- Field testing may be performed only on suspected marijuana, methamphetamine, cocaine, ecstasy, and heroin samples.
- Specialized units (Drug Enforcement, Street Crimes, etc.) may establish procedures for other drug testing kits.
- Designated personnel are trained and authorized to conduct field testing.
- The directive covers various areas of responsibility related to possession of controlled substance charges, including testing, municipal/investigation arrest procedures, and warrant applications.
- Testing of suspected controlled substances should only be performed by trained and authorized personnel.
- If unable to field test, contact the Drug Enforcement Unit for further instructions.
- The initiating officer should observe the field test and ensure the integrity of the substance throughout the process.
- Upon request, authorized department members will:

- Suspected synthetic marijuana and other synthetic drugs will be recovered and submitted to the Regional Criminalistics Division Laboratory for analysis.
- Liquid substances (other than PCP) should be recovered and forwarded to the lab for analysis.
- Officers can utilize the website www.Drugs.com for assistance with identifying prescription drugs.
- After a negative field test result:
- The initiating officer will recover the suspected controlled substance according to established procedures.
- The subject will be released, and any charges will be deferred pending lab analysis of the substance.
- Upon recovery of a suspected controlled substance, the initiating officer will:
- Request an authorized department member to respond for field testing.
- Document the circumstances providing probable cause for the arrest, search, or seizure.
- Include the name, rank, and serial number of the member who conducted the field test.
- Record the name, rank, and serial number of all responding personnel.
- Record the approximate weight of the substance.
- Include the result of the field test, if completed.
- Request laboratory analysis if applicable.
- Detail the disposition of the arrest.
- Report any digital recordings made.
- Cases involving juvenile suspects will be documented in the same manner as with adults.
- The DEU will be contacted, and the Tiburon Automated Reporting System (ARS) report will be titled "Possession of Controlled Substance."
- The DEU will be responsible for the final disposition of all investigation arrest cases for possession of controlled substances except those initiated by the Street Crimes Unit.
- Municipal Court cases involving marijuana with positive field test results will not be analyzed by the lab usually; the city prosecutor will determine if lab analysis is needed for trial.
- Lab analysis requests for marijuana cases in Municipal Court must be submitted electronically through FA Property Connect.
- For cases involving marijuana with a positive field test, lab analysis is needed for trial, and the request should include the detailed phraseology: "Suspected marijuana field tested positive and lab analysis needed for trial on (enter court date)."
