Intellectual Property in Canada
- Patents: Protect new, useful, and non-obvious inventions (e.g., product, process, machine, chemical composition, use).
- Patents Duration: Up to 20 years from the filing date.
- Patents Rights: Exclude others from using, making, or selling the invention.
- Patents Disclosure Grace Period: 12 months.
- Trade Secrets: Protect confidential business information (e.g., invention, business method, manufacturing process).
- Trade Secrets Duration: As long as confidentiality is maintained.
- Trade Secret Rights: No formal rights, but contractual obligations may exist.
- Industrial Designs: Protect the visual aspects, including shape, configuration, pattern or ornament of a product.
- Industrial Design Duration: Up to 15 years from the filing date.
- Industrial Design Rights: Exclude others from making, using, selling or importing something that uses the design.
