Indian Telegraph Act 1885
- Act's Purpose: To amend the law relating to telegraphs in India
- Short Title: Indian Telegraph Act, 1885
- Effective Date: October 1, 1885
- Extent: The whole of India
- Repeal: Replaced by the Repealing Act of 1938
- Definitions:
- "Fund": The Universal Service Obligation Fund, established under section 9-A
- "Universal Service Obligation": Obligation to provide access to telegraph services in rural and remote areas at affordable prices
- "telegraph": Any appliance to transmit signs, signals, writing, images, sounds or intelligence by wire, visual, or electromagnetic means (including radio waves, Hertzian waves)
- "telegraph officer": Person employed, permanently or temporarily, in connection with a telegraph established, maintained or worked by the government or licensed individuals
- "message" Any communication sent by telegraph or given to a telegraph officer to be sent or delivered.
Privileges and Powers of the Government
- Exclusive Privilege: Central Government has the exclusive right to establish, maintain, and operate telegraphs within India, but can grant licenses
- Licensing: Central Government can license individuals to establish, maintain, or operate telegraphs within India on specified terms and conditions
- Wireless Telegraphs: Central Government allows wireless telegraphs on ships and aircraft within Indian territories (and conditions)
Power for Government to Take Possession of Licensed Telegraphs
- Public Emergency/Safety: Central or State Government (or authorized officer) can temporarily take possession of licensed telegraphs during a public emergency or if public safety is in danger, for reasons stated in writing
- Preventing Offenses: Government can restrict or intercept messages for reasons related to sovereignty, integrity, security, or preventing incitement of offenses
