Constitution
The Constitution of India came into effect on January 26, 1950, establishing India as a sovereign democratic republic and a union of states. The document lays down the framework for governance, setting out the country's political code, federal structure, powers of government, and guarantees citizens' rights, including to equality before the law and freedom of speech, assembly, and movement.
Federal Structure
India follows a quasi-federal structure, combining elements of both unitary and federal systems. Power is divided between the central government and state governments, each with their own elected officials. This structure is designed to accommodate India's diverse regions while maintaining national unity. The Constitution also provides for directive principles of state policy that aim to promote social justice and economic development.
Fundamental Rights
Fundamental rights are protected under Part III of the Constitution. They include the rights to equality, life and liberty, freedom of religion, freedom of conscience and belief, freedom of thought and expression, freedom of association, access to justice, and cultural and educational rights. These rights are considered essential for protecting the dignity and integrity of the individual.
Governance
India's governance structures are influenced by the principles of the Constitution, which seeks to promote unity amidst diversity. The Governor, who is appointed by the President, acts as the nominal head of each state government. However, real executive authority lies with the Chief Minister and their Cabinet, who are elected by the Legislative Assembly. Ministry formation occurs through negotiations between political parties to form a stable government.
Election System
India operates a mixed-member proportional representation (MMPR) system for its Parliament and State Assemblies. Members of Parliament (MPs) are elected directly from 543 constituencies across India. Meanwhile, members of state legislative assemblies are elected from single-member districts in the state, using the first-past-the-post system. For the Rajya Sabha, representatives are chosen indirectly by state legislatures, with terms lasting six years. This system ensures representation of diverse interests and regional equity.
