Study Notes
Congress, the Executive Branch, and Health Policy
- The federal government plays a significant role in U.S. health policy, influencing roughly one-third of the $4.5 trillion spent on healthcare in 2022.
- Federal programs, like Medicare and Medicaid, fund healthcare coverage for millions of Americans. These programs also include the Children's Health Insurance Program (CHIP), the Veterans' Health Administration, and the Indian Health Service.
- The Affordable Care Act (ACA) has had a major influence on private insurance, impacting coverage and access. The ACA also created federal insurance Marketplaces and set requirements for private insurance policies.
- Federal agencies, such as the Centers for Medicare and Medicaid Services (CMS), the National Institutes of Health (NIH), the Centers for Disease Control and Prevention (CDC), and the Agency for Healthcare Research and Quality (AHRQ), are heavily involved in health research, regulation, and public health.
- Congress, responsible for creating laws, has committees like Ways and Means, Energy and Commerce, Appropriations and other committees, with jurisdiction over different aspects of health policy. These committees have responsibility for Medicare, Medicaid, and other programs. The role of these committees can vary across legislative bodies (House or Senate).
- The executive branch (primarily the Department of Health and Human Services) implements these laws and manages various federal health programs. This also includes the Veterans Affairs department with TRICARE and the Federal Employees Health Benefits Program.
- The judiciary's role in health policy is often in disputes regarding the constitutionality of legislation or policy implementation. Recent Supreme Court decisions have impacted abortion and other reproductive health services.
- The federal budget process plays a crucial role in allocating resources for healthcare programs. This process involves budget resolutions, appropriations bills, and reconciliation legislation, with important deadlines and process steps involved
- Federal agencies often have informal rulemaking processes, where they propose and adapt regulations. Public input typically is solicited.
