Family and Medical Leave (FMLA) Policy
- FMLA leave is counted against the total 12 or 26 week period allowed.
- Intermittent leave for bonding, birth, or placement of a child cannot be taken.
- The Department may transfer the member to an equivalent position to accommodate recurring periods of leave.
Leave Provisions
- A member will use accrued paid leave while taking FMLA leave, and leave without pay will be granted when all accrued paid leave is exhausted.
- All provisions of sick leave and leave without pay will apply while a member is on FMLA leave.
Administrative Guidelines
- When the need for FMLA leave is unforeseeable, the member must contact their supervisor to obtain verbal authorization and complete the Application For Leave, Form 1 P.D.
- The supervisor must provide sufficient information to establish the qualifying reason for FMLA leave.
- The Human Resources Director has the final authority on FMLA decisions.
Return to Duty
- Upon returning to duty, the member will be reinstated to the same or an equivalent job position.
- Sworn members must refer to the current written directive entitled "Firearms Procedures" regarding firearms qualification prior to returning to duty.
Rights and Responsibilities
- A member's reason for FMLA leave will be kept confidential.
- FMLA is administered and enforced by the Department of Labor.
- A chronic health condition is one that requires periodic visits for treatment, may continue over an extended period, and may cause occasional incapacity.
Leave Entitlement
- All eligible members will be granted FMLA leave with no interruption of benefits, job position status, or anniversary date.
- 12 weeks (480 hours) of FMLA leave per calendar year will be granted for the following circumstances:
- The member's own serious health condition.
- The birth or adoption of a child.
- The care of a child, spouse, domestic partner, or parent who has a serious health condition.
- To fulfill a member's family obligations related to military leave or to care for a military covered service member.
- 26 weeks (1,040 hours) of FMLA leave in a single 12-month period will be granted to eligible members to care for a covered service member.
