Suspension of Driving Privilege due to Support Delinquency

  • The Florida Department of Highway Safety and Motor Vehicles will suspend a person's driver's license and vehicle registration if they have a delinquent support obligation or fail to comply with a subpoena, order to appear, order to show cause, or similar order.

Reinstatement of Driving Privilege

  • The department will reinstate the driving privilege and allow vehicle registration when the Title IV-D agency or the clerk of the court provides an affidavit stating that:
    • The delinquency has been paid
    • A written agreement for payment has been reached
    • A court has granted relief to the obligor and ordered the reinstatement of the license and registration
    • The person has complied with the subpoena, order to appear, order to show cause, or similar order
    • The person receives reemployment assistance or unemployment compensation
    • The person is disabled and incapable of self-support or receives benefits under the federal Supplemental Security Income program or Social Security Disability Insurance program
    • The person receives temporary cash assistance
    • The person is making payments in accordance with a confirmed bankruptcy plan under chapter 11, chapter 12, or chapter 13 of the United States Bankruptcy Code

Limitation of Liability

  • The department is not liable for any license or vehicle registration suspension resulting from the discharge of its duties under this section.

Application of Section

  • This section applies only to the annual renewal of a motor vehicle registration in the owner's birth month.
  • This section does not apply to the transfer of a motor vehicle registration sold by a motor vehicle dealer licensed under chapter 320, except for the transfer of registrations that includes annual renewals.
  • This section does not affect the issuance of the title to a motor vehicle, notwithstanding s. 319.23(8)(b).
