Enhanced Penalties for Certain Offenses

    • A state, county, or municipal park, a community center, or a publicly owned recreational facility: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • A physical place for worship: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • A convenience business: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
  • Manufacturing methamphetamine or phencyclidine, or possessing any listed chemical with intent to manufacture methamphetamine or phencyclidine:
    • Commission or attempted commission of the crime in a structure or conveyance where any child younger than 16 years of age is present: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, with a minimum term of imprisonment of 5 calendar years.
    • Commission of the crime causing any child younger than 16 years of age to suffer great bodily harm: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, with a minimum term of imprisonment of 10 calendar years.

Purchase of Controlled Substances

  • Except as authorized by this chapter, a person may not purchase, or possess with intent to purchase, a controlled substance.
  • Penalties for violating this provision:
    • Controlled substance named or described in s. 893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)5: felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • Controlled substance named or described in s. 893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)6., (2)(c)7., (2)(c)8., (2)(c)9., (2)(c)10., (3), or (4): felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • Controlled substance named or described in s. 893.03(5): misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

Delivery of Controlled Substances to Minors

  • Except as authorized by this chapter, a person 18 years of age or older may not deliver any controlled substance to a person younger than 18 years of age.
  • Penalties for violating this provision:
    • Controlled substance named or described in s. 893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)5: felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • Controlled substance named or described in s. 893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)6., (2)(c)7., (2)(c)8., (2)(c)9., (2)(c)10., (3), or (4): felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • Any other controlled substance: felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Possession of Controlled Substances

  • A person may not possess a controlled substance unless such controlled substance was lawfully obtained from a practitioner or pursuant to a valid prescription or order of a practitioner.

  • Penalties for violating this provision:

    • Controlled substance named or described in s. 893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)5: felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    • Controlled substance named or described in s. 893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)6., (2)(c)7., (2)(c)8., (2)(c)9., (2)(c)10., (3), or (4): misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
    • Controlled substance named or described in s. 893.03(5): misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.### Prohibited Acts by Prescribing Practitioners
  • Employing a trick or scheme to assist a patient or another person in obtaining a controlled substance

  • Writing a prescription for a controlled substance for a fictitious person

  • Writing a prescription for a controlled substance for the sole purpose of providing a monetary benefit to oneself or another

Medical Necessity

  • If a prescription was written without medical necessity, it may be considered as evidence in determining whether the prescribing practitioner violated the law

Penalties

  • Violating paragraph (a) is a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084
  • If the prescribing practitioner received $1,000 or more in payment or wrote a prescription for a quantity of a controlled substance meeting the threshold for trafficking, the violation is reclassified as a felony of the second degree

Exemptions

  • The provisions of subsections (1)-(8) do not apply to certain classes of persons, including:
    • Pharmacists
    • Practitioners
    • Persons who procure controlled substances in good faith and in the course of professional practice
    • Hospitals
    • Officers or employees of state, federal, or local governments
    • Common carriers
    • Manufacturers, wholesalers, and distributors
    • Law enforcement officers

Enhanced Penalties for Injuries to Law Enforcement and Other Officials

  • If a violation of this chapter results in a serious injury to a law enforcement officer, firefighter, emergency medical technician, or other specified officials, the person commits a felony of the third degree
  • If the injury results in death or great bodily harm, the person commits a felony of the second degree
