Second Amendment and Federal Firearms Laws
- The Second Amendment: ratified on December 15, 1791, as part of the Bill of Rights
- States that "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed"
Evolution of the Second Amendment
- United States v. Miller (1939): The Supreme Court rejected the argument that the National Firearms Act of 1934 (NFA) violated the Second Amendment rights of two individuals
- The Court stated that the NFA did not violate the Second Amendment, as there was no evidence that the shotgun in question had any reasonable relationship to the preservation or efficiency of a well-regulated militia
- District of Columbia v. Heller (2008): The Supreme Court held that the Second Amendment confers an individual right to possess firearms, striking down the District of Columbia's handgun ban and safe storage requirement
