Fire Extinguisher Service and Installation
- Governing Laws: Texas Insurance Code - Chapter 6001 and Texas Administrative Code - Section 34.500
- Purpose: The chapter is to safeguard lives and property by regulating the leasing, selling, installation, and servicing of portable fire extinguishers, and planning, certifying, installing, and servicing fixed fire extinguisher systems. It also prohibits equipment not listed by an approved testing laboratory.
- Definitions:
- Firm: An individual, partnership, corporation, or association.
- Fixed fire extinguisher system: An assembly of piping, conduits, or containers that convey liquid, powder, or gases to dispersal openings to suppress or extinguish fires.
- Hydrostatic testing: Pressure testing by hydrostatic methods.
- Insurance agent: An individual, firm, or corporation licensed under Subchapter E, Chapter 981; or Subchapter A, B, C, D, E or G, Chapter 4051; or an individual authorized to represent an insurance fund or pool created by a municipality, county, or other political subdivision.
- Portable fire extinguisher: A device containing liquid, powder, or gases to suppress or extinguish fires.
- Portable fire extinguisher inspection: A monthly inspection to ensure: the extinguisher is in its designated location, has not been tampered with, and has no obvious damage.
- Service/servicing: Servicing a portable fire extinguisher or fixed system via charging, filling, maintaining, recharging, refilling, repairing, or testing.
- Registered firm: A firm holding a registration certificate.
Subchapter B - Powers and Duties of Commissioner, Department, and State Fire Marshal
- Administration of Chapter: The department administers the chapter. The commissioner may issue rules, determined necessary to administer the chapter.
- Adoption of Rules: The Commissioner uses recognized standards, including those published by the NFPA, federal regulations, nationally recognized standards-making organizations, and manufacturer's installation manuals.
- Rules Restricting Advertising or Competitive Bidding: The commissioner may not restrict advertising usage, personal appearance of the holder, size or duration of an advertisement, or restrict advertisements under a trade name.
- General Powers and Duties of Department: The department evaluates the qualifications of firms seeking to be registered to install/service portable fire extinguishers or fixed systems, or seeking approval as a testing laboratory. They issue registration certificates for these firms and licenses for individuals and groups.
Subchapter D - Registration, License, and Permit Requirements
- Firm Registration Certificate: Required for firms engaging in the installation/service of portable extinguishers or fixed systems.
- Branch Office Registration: Required for each separate office location, must be part of a registered firm.
- Hydrostatic Testing: Certificates required before performing hydrostatic testing, in alignment with U.S. DOT specs.
- Required Insurance Coverage: Evidence of general liability insurance is necessary with minimum coverage for bodily injury and property damage per occurrence, and aggregate amounts.
- Employee Licensing: Required for installing/servicing portable extinguishers or fixed systems (excluding apprentices)
- Apprentice Permit: Required for activities as an apprentice.
Subchapter E - Renewal of Registration, License, or Permit
- Renewal Required: Registration certificates/licenses are valid for two years, with renewal fees payable on a per-year basis.
- Notice of Expiration: Written notice of the expiration date is given 30 days prior to expiry.
- Renewal Procedures: Renewal fees are payable prior to the expiration date. There's a fee for renewal if a registration certificate or license has been expired for over 90 days or two years, and it depends on the number of days expired.
