Background
- This policy was written to establish the authority of the Bernalillo County Fire Department officers and their ability to direct subordinates.
- Consequences of failing to follow orders are outlined by the policy
- Support is also given to not following unlawful or unsafe orders
Orders & Insubordination
- The Fire Chief delegates authority to give orders to officers.
- Officers must not exceed their authority when giving orders.
- Subordinates must respond to lawful orders from superior officers.
- In the case of orders relayed by a lower-ranking officer, the subordinate still must respond.
- Insubordination exists when there is a deliberate refusal to obey a lawful or safe order.
- Insubordination can be openly stated or silently withheld services or work.
- Employees must follow all instructions and cannot choose which ones to follow.
- Verbal orders must be repeated back for confirmation of understanding and correction by the giver.
- Disrespect or disruption of an officer's order is considered insubordination.
- Insubordination can result in disciplinary measures such as dismissal.
- Refusal to obey a lawful order constitutes insubordination and is considered a major offense.
- This may constitute grounds for disciplinary action up to and including, dismissal.
- Officers are required to uphold and enforce all orders, policies, and procedures.
- Any disagreement with orders, directives, etc. should be discussed with your immediate officer.
- Disagreements with a SOG or P&P should be in writing, sent through the chain of command, and discussed/considered by the Chief Staff
- Any and all changes will be approved or disapproved by the Fire Chief or their designee.
- Members are prohibited from publicly criticizing or commenting derogatorily about instructions or orders received from a superior officer.
- No member can obey any order they know, or should know, requires them to commit an illegal act.
- When there is doubt about the legality, the individual should discuss it with the issuing officer.
- If no resolution is reached, the member should request that the Commanding Officer of the issuing officer be contacted.
- The Commanding Officer will investigate and determine the legality of the order.
- If the order is determined to be lawful, it must be followed.
- If the order is determined to be illegal, it must be altered.
Conflicting Orders
- If a member receives conflicting orders:
- Immediately present the facts to the officer from whom the latest order was received.
- If, after presenting the facts, the officer from whom the last order was received insists upon the execution of that order, it shall be obeyed.
- The officer giving the conflicting order is responsible for notifying the officer who gave the original order as soon as practical.
