Important Judgments and Case Laws

Constitution and Amendments

  • Article 15(4) was inserted in the Constitution through the 1st Amendment Act 1951, allowing reservation for SCs and STs in educational institutions.

Landmark Cases

  • Champa Kam Dorairajan v. State of Madras (1951): Reservation cannot be given to SCs and STs in educational institutions, leading to the 1st Amendment Act 1951.
  • Re Berubari Union Case (1960): The preamble is not a part of the Constitution and cannot be regarded as the source of any substantive power.
  • Keshavanand Bharati v. State of Kerala (1973): The Basic Structure Doctrine Case; the Supreme Court held that each and everything in the Constitution can be amended by Parliament under Article 368 except the basic structure/features of the Constitution.
