    Study Notes

    • Scope of Practice Restrictions: Legal paraprofessionals (LPs) in family law may not handle matters involving QDROs, division of business entities, or commercial property, or appeals to higher courts, unless they meet additional qualifications specified by the court.

    • Family Law Endorsement Requirements (Associate/Bachelor/MLS/JD): To practice family law, an LP needs 3 credit hours in family law, 6 in civil procedures, 3 in evidence, 3 in legal research and writing, and a minimum of 120 hours of experiential learning, including advocacy. A bachelor's degree with the required coursework, an Associate degree with the required coursework and certificate, or Master of Legal Studies (MLS) is needed to qualify. A Juris Doctor (JD) is also an acceptable qualification. Those with foreign law degrees follow similar requirements concerning family law. Those not meeting the educational requirements must have 2 years of substantive experience in the area to qualify.

    • Supervision Requirement (Associate, Bachelor or MLS qualifications): One year of substantive law-related experience under a lawyer's supervision is also required with an associate-level degree in paralegal studies or an equivalent, bachelor's degree, or an MLS.

    • Additional Requirements (for all types): All applicants must also meet age (21+ years), citizenship, good moral character, and licensing examination passing requirements outlined in the section.

    • Identification: LPs must include their name, the title "Arizona Legal Paraprofessional" or "LP," and license number on all documents. They must also provide this information to anyone who asks.

    • Reporting Requirements: LPs who are disbarred or have an admission to practice denied must report this to the board and state bar within 30 days. Similarly, LPs must report any disbarments within 30 days.

    • Code of Conduct: LPs are bound by Supreme Court Rule 42, Arizona Rules of Professional Conduct, with some modifications (e.g., "lawyer" is replaced with "legal paraprofessional"). LPs must adhere to Supreme Court Rules 41, 43, and 32(c)(13) as well.

    • Prohibited Actions: LPs cannot represent themselves as lawyers or do any practice that goes beyond what their particular license allows. They cannot provide advice on potential legal rights, remedies, defenses, etc.,unless they have the specific endorsements to do so.
