- There are 23 restrictions on license exceptions, which may not be used under certain circumstances.
Circumstances that Restrict License Exceptions
- If authorization to use a license exception has been suspended or revoked, or the intended export does not qualify for a license exception.
- If the export or reexport is subject to one of the ten General Prohibitions, is not eligible for a license exception, and has not been authorized by BIS.
- If the item is primarily useful for surreptitious interception of wire, oral, or electronic communications, or related software.
Specific Restrictions
- No license exceptions apply for 5E001.a or 5E980.
- Items controlled for missile technology (MT) reasons may not be exported under certain license exceptions.
- Items exported or reexported to a sanctioned destination (e.g., Cuba, Iran, North Korea, Syria, etc.) or a license is required based on a limited sanction (e.g., Russia or Belarus).
- Technology required for the 'development' or 'production' of certain items (e.g., photon detector, microbolometer detector, etc.) is not eligible for certain license exceptions.
- Items controlled under certain ECCNs (e.g., 2A983, 2A984, 2D983, 2D984, 2E983, or 2E984) are not eligible for certain license exceptions.
- Items exported or reexported to or within the People's Republic of China (PRC) are not eligible for certain license exceptions.
- Items subject to the license requirements of §742.11 of the EAR are not eligible for certain license exceptions.
- 'Military commodities' subject to ECCN 0A919 are not eligible for certain license exceptions.
Country-Specific Restrictions
- '600 series' items destined to, or in, Country Group D:5 or Hong Kong are eligible for certain license exceptions.
- Items controlled under ECCNs 0A521, 0B521, 0C521, 0D521, and 0E521 may only be authorized by License Exception GOV or an item-specific license exception.
Other Restrictions
- If a party to the transaction is listed on the Unverified List, no license exceptions are available.
- If the exporter or reexporter does not receive a required license or written statement from the Government of the Hong Kong Special Administrative Region, no license exceptions are available.
- The reexport or transfer of firearms classified under ECCNs 0A501 or 0A502 under certain circumstances is not eligible for certain license exceptions.
- The export, reexport, or transfer of certain items to a party designated on the OFAC SDN list is not eligible for certain license exceptions.
General Provisions
- All license exceptions are subject to revision, suspension, or revocation, in whole or in part, without notice.
- BIS may stop a shipment or export transaction at any stage to prevent an unauthorized export or reexport.
- BIS may inform an exporter to submit a notice before using a license exception.
