Police-Involved Shooting Protocol

  • When safe to do so, render medical aid consistent with training and available equipment
  • Communications personnel:
    • Dispatch personnel to render assistance and/or secure the scene as necessary
    • Acknowledge the request for EMS and notify CFD
    • Make notification as required by the Emergency Notification Guide

Initial Response

  • Homicide Bureau Supervisor:
    • Ensure notification is made to the independent investigative agency
    • Function as the liaison between the agency and the Division
    • Complete the required administrative paperwork (e.g. Use of Force Report and Data Processing Worksheet, form U-10.164) and forward it as outlined in the Homicide Bureau SOP

Officer Support

  • Provide involved personnel with any assistance, information, or other support as needed or requested
  • Officer Support Team members are subject to being subpoenaed to attend legal proceedings and testify to what they are told by the involved personnel
  • Officer Support Team members are cautioned not to discuss the incident

Investigations

  • Internal Affairs Bureau:
    • Conduct a concurrent administrative investigation when directed
    • Note: Personnel who are the focus of a criminal investigation may invoke their constitutional rights (does not apply if the investigation is strictly administrative in nature)
  • Firearms/Police-Involved Death Review Board:
    • Review all information concerning the incident
    • Determine whether the discharge of the firearm was within Division policy
    • Render a finding in accordance with the Firearms/Police-Involved Death Review Board SOP

Scene Security

  • Sworn personnel shall protect the scene as any other serious crime scene in accordance with the “Serious Crime Scenes, Threatened Officer Protection, and Guard Duty” directive
  • Only personnel assigned to investigate a police-involved shooting shall be permitted within the protected area of the shooting scene
  • Exception: Chairperson or the responding member of the Firearms/Police-Involved Death Review Board or his/her designee, who shall be shown the scene at the first reasonable opportunity

Failure to Qualify with a Firearm

  • Sworn personnel who fail to qualify by the conclusion of the first session will be scheduled to attend firearm technical skills development.
  • Failure to qualify in three attempts during the first qualification session with a Division-approved firearm prohibits sworn personnel from carrying the firearm until qualifications are met.
  • Sworn personnel who fail to qualify with their Division-approved firearm must surrender the firearm to Ordnance Unit personnel if the firearm is City-owned.
  • Sworn personnel are allowed a total of three qualification attempts per day during normal Ordnance Unit hours until qualifications are met.

Failure to Qualify with a Shotgun

  • Sworn personnel who fail to qualify after three attempts during the first qualification session are prohibited from carrying a shotgun.
  • A written order from the Chief of Police will be issued to sworn personnel who fail to qualify, prohibiting them from carrying a shotgun.
  • The original order will be placed in the employee's firearms file, and copies will be forwarded to the involved employee's bureau commander/manager and deputy chief.

Failure to Qualify with a Division-Approved Patrol Rifle

  • Ordnance Unit personnel will place a written order in the employee's firearms file and email copies to the involved employee's bureau commander/manager and deputy chief.
  • The immediate supervisor of sworn personnel failing to qualify will be immediately notified.
  • Arrangements will be made to transport the officer and marked police vehicle to the duty station.

Remedial Training

  • Sworn personnel who fail to qualify in three attempts during the first qualification session will be provided remedial training prior to any further attempts to qualify.
  • Remedial training can range from verbal instruction to regimented firing of the qualification course.

Attending Firearms Qualification

  • Sworn personnel must attend firearms qualification phases as scheduled.
  • Failure to attend without a legitimate conflict may result in discipline and being relieved of their firearm at the end of the year.

Obtaining Authorization to Carry a Division-Approved Firearm

  • Sworn personnel must complete a Firearms Qualifications form, S-70.102, listing the information specific to the Division-approved alternate and/or off-duty/back-up firearm or patrol rifle.
  • The firearm must be submitted to Ordnance Unit personnel for inspection.
  • Sworn personnel must qualify with the firearm on the OPOTA pistol or patrol rifle qualification course.

Firearms Qualification Phases

  • Review individual circumstances for those who fail to complete a phase
  • Recommend remedial training or disciplinary action

Sworn Personnel Responsibilities

  • Attend scheduled firearms qualification phases
  • If unable to attend, advise the bureau commander/manager and reschedule within 30 calendar days
  • Failure to qualify when physically able may result in discipline and being relieved of firearm at the end of the year

Authorization to Carry Alternate/Off-Duty Firearms

  • Return the replacement firearm to the issuing unit after obtaining a temporary firearm

Sworn Personnel Requesting Permission to Fly Armed

  • Obtain TSA training
  • Provide advance notice to the airline of intent to fly armed
  • Complete the Flying Armed Original Letter of Authority and forward it to the deputy chief
  • If approved, contact a Records Technician Supervisor to obtain a NLETS teletype

Deputy Chief or Chief Responsibilities

  • Review the Flying Armed Original Letter of Authority to ensure it meets the criteria
  • Sign and return the form to the involved employee if approved

General Firearms Guidelines

  • Sworn personnel working in plainclothes shall carry a primary service firearm or authorized alternate firearm
  • Sergeants and officers returning to a uniformed assignment shall return Division-issued alternate firearms to the Ordnance Unit
  • Sworn personnel in units with specialty firearms shall return all issued firearms to the Ordnance Unit when departing the unit

Shotgun Guidelines

  • Sworn personnel shall annually complete a familiarization class with the shotgun during the shotgun qualification phase
  • Only sworn personnel who have qualified with the shotgun shall be permitted to carry one
  • Personnel who have not qualified with a shotgun shall not deploy, carry, or use the shotgun except under critical circumstances

Patrol Rifle Guidelines

  • Only sworn personnel trained and certified as a Patrol Rifle Officer (PRO) shall carry the patrol rifle
  • Sworn personnel shall refer to the “Equipment” section of the Patrol SOP for further instructions
