Employer Identification Number (EIN) Guidance

• On January 9th, 2025, a session was held to guide individuals through the process of obtaining an Employer Identification Number (EIN).

Business Name Recommendations

• It is recommended to use two Christian names for the business name.
• This recommendation is due to the fact that in the future, credentials like a new passport would have two names.
• Using three names can be confusing.
• The second name doesn't need to be a surname.

Required Information

• To get an EIN, you need your full legal name (including middle name) and Social Security number.
• Ensure that you have internet access.

Registered Mail

• It's not critical to register the chosen business name via mail before applying for an EIN.
• An EIN can be obtained when setting up a new business, and the registered mail can be sent afterward.

Concurrent Processes

• Unwinding the secured party leaner of private express trust one should occur before or alongside setting up the CSA and notarizing it.
• Terminating the trust and establishing a new business with an EIN and registered mail can happen concurrently.

IRS Actions & EINs

• Form 56 and other unwinding steps do not prevent you from getting an EIN.
• Priority should be given to terminating Private Express Trust One and completing Form 56 to revoke the trust.
• Ensure the chosen proxy nickname is finalized before doing the registered mail.

Timeline Flexibility

• You can obtain an EIN and set it aside while completing termination and revocation procedures.
• Registered mail to the proxy nickname should follow soon after getting the EIN due to dating considerations.
• Aim to send the registered mail within one to two weeks of obtaining the EIN.
• Registered mail places the proxy name into international commerce.

EIN & Legal Name

• The EIN is associated with the full legal name, including the full middle name.
• The proxy nickname functions as a trade name or "doing business as" (DBA).
• The IRS can see the proxy nickname, but the EIN is linked to the full legal name in the business master file.
• The full legal name should match what is on the Social Security card.
• It is important to spell out the full middle name of your legal name.

Individual vs. Business Master File

• The individual master file at the IRS is associated with your Social Security number and contains tax returns and debt information.
• Creating a new business generates a business master file.
• The business master file and the individual master file are linked behind the scenes.

Agency Creation

• Obtaining an EIN creates agency, which represents an agreement.
• The agreement is between the full legal name and the proxy nickname.
• The proxy nickname can be used and adapted over time, eventually leading to the creation of a trust.
• The individual obtaining the EIN is the authorized representative and agent for the new business.

PO Boxes & Business Address

• The business address for the proxy nickname can be a home address or a PO box.
• The IRS application allows for both a main address and a secondary address.
• The birth certificate address is not the main address.
• It's acceptable for the business address associated with the proxy nickname to be the same as your home address.

IRS Address Matching

• The business address connected to the full legal name should match what the IRS already has on file connected to the Social Security number.
• The individual portal with ID.me can be used to check and update the address with the IRS.
• The PO box can be used as the secondary address if the street address is used for the primary address.

Existing Trusts

• Trusts based offshore should have a separate mailing address.
• It is recommended that you use your home address for the EIN and proxy nickname.

Form 98

• It is advised to hold off on getting a 98 form.

Passport Details

• The proxy nickname is created and functions as a trade name under the EIN.
• It can become the secured party leaner in a commercial security agreement (CSA).
• Passports can be acquired with the proxy nickname.

Driver's License

• Current driver's licenses are under the current legal name.

Voters

• Rescinding voter registration is still advised.
• Voting is a trustee duty so action as a trustee should be stopped.

IRS Website

• To apply for an EIN, visit irs.gov.

Logging In

• Logging in is not required to apply for an EIN.

Applying For EIN

• You can locate the "Apply for an Employer EIN" section on the IRS homepage.
• To get an EIN, it is important that your business is in the US.

EIN Assistant

• You need your social security number to apply
• Select the correct information regarding your business to avoid error.

Government System Warning

• A warning about using a government system will appear; click "okay" to proceed.
• The EIN assistant will guide you through the application process.

Entity Types

• The entity type for this process is sole proprietor.
• Other entity types, such as single-member LLCs, require registration with the state.

Sole Proprietorship

• A sole proprietor is not registered with any agency and does not require licenses.
• The goal is to create agency (agreement) between the Social Security name and proxy nickname.

EIN Errors

• If you encounter errors, try again at different times or use a different browser.
• Using a VPN or firewall may cause issues; try removing them or using Google Chrome.

Browser Considerations

• Brave browsers sometimes experience issues.
• Safari can be used on Apple products, but may have hiccups.
• Google Chrome is generally reliable.

Prior EINs

• Those with existing sole proprietor EINs must call or write to add the proxy nickname as a new trade name.

LLC EINs

• LLC EINs are a different entity type.
• There's an annual renewal for LLCs and the business has to be registered at a state level.

Single EIN

• The key is that a sole proprietor can only have one EIN.
• The main thing is that there can only be one EIN attached to the social security number.

Primary Reason

• The primary reason for requesting an EIN is for banking purposes.

Full Legal Name

• It is very important that you submit your full legal name.
• You must spell out your middle name, do not only submit the initial.

Previously Assigned EIN

• If the website tells you that you have already been assigned an ENI in the pact then you must call.

Updating

• The number to call is 808-829-4933.
• If you already have one and want to update the record and add an EIN then also request that they mail the 147C letter.

Agent

• Calling early usually ensures a minimal hold time.
• You may have to verify your ID.

CP575

• Having them mail a copy of information is a way to get the full EIN is you can't remember it.

Address Details

• You are able to put your PO box as a mailing address option.
• The system may ask if you want a secondary address as well which can be a street address.

Street Address

• Sometimes a PO box is not accepted for a street address and then they're going to ask you to enter a street address.

Zip Code

• Always get your zip plus four.

Signature

• The signature line of the secured party leaner on the CSA is where you include the EIN.

Collateral Details

• The collateral on the CSA does not change. It's the same as the sample.

Authorized Rep

• The signature for the auth rep can be shortened to 'AUTH period, R -E -P period.'

Trust Notary

• The time of the the trust being notarized must be the same day or after the commercial security agreement.

Sole Proprietor Details

• Provide all correct information regarding your entity status and address.
• The website will auto correct your address but make sure that it is correct.

Future Editing

• The proxy name can be edited in the future by either calling or writing a letter.
• Contacting them may depend on who the agent is.

Name Issues Correction

• If there and spelling errors make sure to enter it in correctly.
• Do not put the a PO box, put your home address.

Start Date

• The Proprietor Start Date can only go back to February 2000.

Other Details

• When the other details section it asks what kind of services they provide, make sure to put information returns.
• In the application online, you can only select to receive the letter over the computer.

Printing

• In the print page make sure to take a screen shot or press 'control P/ command P' to print.

Saving the file

• Once you have your EIN save the file as a PDF because it is the CP575 letter.
• Usually, the PDF is automatically saved as "EIN and then the number spelled out."

Responsible Party

• There will also be a space for 'responsible party' that needs to be filled with the social security name.
• It is known that the legal name is not the owner, it's the social security name.

Error Issues

• If you get error 101 then you must call them in order to fix it.
