Driving Documents and Police Powers
- It is an offence to drive a motor vehicle without a valid driving licence.
- Police officers have the power to stop vehicles on the road.
- Officers can demand production of driving documents, including licence, provisional licence, insurance, test certificate, and goods vehicle certificate.
- This power applies to drivers, those suspected of being involved in accidents, and those suspected of committing road traffic offences.
- If a learner driver is accompanied by a qualified driver, officers can demand production of the driving licence from the supervising driver.
- When stopping a vehicle, officers can ask the driver for their name and address, and the name and address of the vehicle's owner.
- If an officer demands production of a driving licence, they can also ask the driver for their date of birth.
- A defaced, mutilated, or unreadable licence is not considered to have been produced.
Production Notices
- If a person cannot produce driving documents on demand, they will be issued with a production notice (Form 55/8).
- They will be given 7 days to produce the document(s) at a police station of their choice.
- Failure to produce the required documents within 7 days is an offence.
- Production notices can be completed electronically at the roadside, with a Roadside Enforcement Notice (REN) card issued to the driver.
- Alternatively, a paper form 55/8 can be issued.
- All details of the encounter should be recorded in an officer's notebook.
- The procedure is complete when the form 55/8, either electronic or paper, is forwarded.
- If an offence is discovered, further investigation is required.
Offences
- It is an offence to fail to produce driving documents immediately when asked or to fail to produce them at the specified police station within 7 days.
- The offence is complete only if the driver was given the opportunity to produce the documents at a specified police station and 7 clear days have elapsed.
