Implied Powers
- Implied powers are not specifically stated in the Constitution but are inferred from expressed powers.
- Examples include regulation of labor-management relations, building hydroelectric power dams, and constructing the interstate highway system.
- Other instances involve making certain federal crimes (e.g., moving stolen goods, gambling devices) and prohibiting racial discrimination in public places.
Inherent Powers
- Inherent powers are those held by the national government simply by being a sovereign state.
- Include the ability to regulate immigration, deport aliens, acquire territory, grant diplomatic recognition, and protect the nation against rebellion or overthrow.
Federalism
- Federalism refers to the division of power between a central government and regional governments.
- Powers in a federal system are divided among national (exclusive/federal), state (reserved), and shared (concurrent) authorities.
Power Distribution
- National powers include maintaining military forces, declaring war, coining money, regulating trade, and making treaties.
- Shared powers cover enforcing laws, establishing courts, borrowing money, securing the population, building infrastructure, and collecting taxes.
