Response to Resistance Documentation
- Response to resistance information must be documented in the General Offense Incident narrative and the BlueTeam database in the following situations:
- A deputy takes an action resulting in injury or death
- A deputy discharges a firearm (not for training or recreational purposes)
- A deputy applies force using lethal or intermediate weapons
- A deputy applies weaponless physical force
- When utilizing force, a General Offense/Incident Report must be completed by the deputy using force
- If multiple deputies use force, only one report is required
- The supervisor is responsible for completing the BlueTeam entry and ensuring it is initiated during the same shift as the incident
CEW Usage
- CEWs are only used when lesser means of control have failed or are not appropriate
- CEWs must be used consistently with training and manufacturer guidelines
- Law enforcement and corrections deputies deploying CEWs are responsible for removing probes, with exceptions for soft body tissue areas
- Photographs must be taken of the impact site before and after probe removal
Response to Resistance Levels
- Level 6: Aggravated Physical - subject makes overt, hostile movements with intent to cause death or great bodily harm
- Level 5: Aggressive Physical - subject makes overt, hostile movements that may cause injury but not death or great bodily harm
- Level 4: Active Physical - subject makes physically evasive movements to defeat control
- Level 3: Passive Resistance - subject refuses to comply or respond
- Level 2: Verbal Non-Compliance - subject verbally refuses to comply with requests
- Level 1: Compliance - subject responds to commands
Response Options
- Lethal Force Option - force likely to cause death and not merely serious bodily harm
- Aerosol Defense Spray - deputy must move the subject to fresh air, flush eyes and skin with water, and read the O.C. Administrative Warning to the subject
Deputy Responsibility
- Deputies must immediately notify their supervisor and render appropriate medical aid in the event of less-lethal force or physical force use
- Deputies must consider an individual's mental, physical, or other incapacities when using de-escalation tactics
De-Escalation
- Deputies should attempt to use de-escalation tactics when safe and time permits to reduce the need for force
- Deputies must consider factors beyond an individual's control, such as medical conditions, mental impairments, or language barriers
- Deputies must continually assess the effectiveness, reasonableness, and necessity of their actions while using force
