    Procedure to Apply When There's a Lacuna

    • In the absence of a provision, Section 35 of the High Court Law of Northern Nigeria prohibits the application of English rules; instead, other laws should be looked at.

    Search Procedure

    Area Court

    • In Lagos, governed by the Magistrate Court Law 2009, there are no grades of Magistrate Court.
    • The Magistrate Court can try all offences except capital offences.
    • The Magistrate Court has a limited sentencing power, which is 14 years imprisonment (Section 29(5) MCL).
    • If the sentence provided for by the law creating the offence is more than 14 years, the Magistrate Court cannot impose a sentence more than 14 years.
    • An appeal can be made against the sentence to the High Court, on the ground that the Magistrate Court has exceeded the 14 years maximum.

    Habeas Corpus
