  • All officers are responsible for properly handling and processing evidence and property.
  • Strict adherence to departmental rules and procedures is mandated.
  • Property types include firearms, money, drugs, drug paraphernalia, jewelry, and other items.
  • Evidence is defined as testimony, objects, writings, or information presented in court to prove facts.
  • Rules of evidence protect the jury from irrelevant or prejudicial evidence.
  • Safekeeping involves temporarily holding property from an identified owner.
  • Found property is undisputedly discovered property with potentially unknown owners.
  • Seized property is directly or indirectly connected to crimes.
  • Recovered property is stolen property retrieved by law enforcement.

Evidence Collection Procedures

  • Maintain evidence integrity; ensure no alterations or loss of identity.
  • Photographic documentation required before handling evidence.
  • Measurements & location are recorded
  • Evidence must be carefully marked and packaged to prevent damage.
  • Generous samples of materials (liquids, stains, etc.) will be collected to allow extensive testing without contamination
  • CSI personnel handle complex evidence collection, and the requesting officer documents their involvement.
  • Fentanyl-laced pills/powder must be handled carefully.

Firearms Evidence Procedures

  • Firearms involved in significant crimes (shootings, homicides) need careful handling.
  • Relevant evidence includes weapons, fragments, bullets, pellets, patterns, wadding, cartridge cases, measurements of distance and bullet/casing location , bullet holes and slugs .
  • Firearms are unloaded and rendered safe before packaging; contact a range master as needed.
  • Evidence Custodian must be informed if mechanical unloading is not possible.
  • Weapon packaging details the loaded/unloaded status and barrel orientation.
  • Diagrams are made of the weapon location of bullets to demonstrate order of firing, each side of the cylinder is marked.
  • Required packaging information includes firearm serial number, make, color, model type, caliber, barre length
  • Handguns treated as evidence are packaged according to Evidence Package and Handling class instructions.

Documents Procedures

  • Handle documents carefully using tweezers.
  • Place documents in clear plastic packaging wherever possible.
  • Complex documents like suicide notes are handled by crime scene investigators.
  • Items at a scene with evidentiary value are handled minimally to limit contamination.

Bloodstained Objects Procedures

  • Fabric items should be packaged loosely and separately, wrapped in paper, never plastic or newspaper.
  • Officers document procedures and chain of custody paperwork, and hang clothing in a secure area for drying.

Blood Sample Procedures

  • Medical staff draws blood following appropriate medical standards.
  • Samples not related to bloodborne pathogens are placed in appropriate evidence packaging.
  • BAC/Toxicology kits are sealed with signed red evidence tape.
  • Kit details include nurse name, and attached laboratory form to the container.
  • Samples for BBP exposure testing (HIV, HBV, HCV) are drawn at Concentra Urgent Care facilities.
  • Samples are sent to testing facilities by Concentra.
  • Officers should contact Concentra for BBP exposure testing

Sexual Assault Kits Procedures

  • Officer completes report and property page for all evidence if in possession.
  • Document type of property as evidence.
  • If an anonymous victim is involved a “Jane Doe” kit is used.
  • The medical centre holds it until the victim activates it for processing or the statute of limitations expires .

BBP Exposure Test Procedures

  • NRS 441A.320 mandates blood tests for HIV/STDs in sexual assault cases.
  • Blood draws for exposure testing (BBP) are performed at Concentra Urgent Care facilities.
  • Concentra sends samples to the appropriate testing facility.
  • Concentra delivers results to employees/officers and suspects' results go to Dori Hilson, (CNLV HR) who informs the Supervisor.

Buccal Swab Kits Procedures

  • Arrestees charged with felonies, unless previously submitted, must provide buccal swabs at the time of booking.
  • swabs and envelope are supplied by NLVCCC staff.
  • Officers obtain the buccal swabs from arrestees.
  • Buccal swabs do not require refrigeration and should not be placed in the refrigerator.

Explosives or Flammable Materials Procedures

  • Do not package explosives; these are collected by North Las Vegas Fire Department.
  • Contact Fire Department for disposal and turn them over to their care
  • Officer documents disposal method, amount, and condition using photographs.
  • Sample packaging is done in consultation with the Evidence Vault if the material needs testing or is evidence.

Presumptive Field Testing Kit Protocols

  • Field tests for cocaine, methamphetamine, or heroin are done under ideal conditions.
  • Testing is performed at the station or jail if field conditions are poor.

Arrests Officer Procedures in Controlled Substances Cases

  • Determines if the substance should be arrested based on an alleged criminal offence.
  • Books the arrested individual.
  • Contacts a certified examiner for Presumptive Field Tests before booking the substance into evidence.

Certified Examination Officer Procedures

  • Determines if the substance is a controlled substance and quantity warrants a field test.
  • Conducts Field Tests as per training under safe conditions.
  • Based on analysis, books the controlled substance or releases to the arresting officer after documenting results.
  • Records the outcome on the test kit checklist and related forms.

Supervisor Responsibilities in testing inaccuracies

  • Maintains test kits.
  • If no controlled substance is indicated, the supervisor determines next actions (possible charges).

Testing Inaccuracy Procedures

  • First error: Two-hour training session on proper test procedure.
  • Second error: Minimum one-year suspension of testing authority. Re-certification may be requested

Impression Marks Procedures

  • Photograph impression marks using 90° angles and with and without scale, both RAW and JPEG formats for tool marks are useful.
  • Creates casts using casting material.
  • The object bearing the mark is collected preferentially for impressions.

Booking Evidence and Property Procedures

  • All evidence is recorded on computer-generated Property Report Forms.
  • Personal identifying information (drivers' licenses, etc.) is included.

  • Confiscated controlled substances are counted/weighed.
  • A copy of the Presumptive Test result form is included inside the evidence.

Money Booking Procedures

  • Money can be classified as Evidence (E), Safekeeping (X), Found (F), or Impounded/Seized (I).
  • Detailed descriptions of any evidentiary value are included, denomination counts are not required unless specific.
  • Found/Safekeeping is for non-evidentiary money, and money is deposited in a city account unless claimed.

Packaging Procedures

  • Evidence items are packaged in appropriate sealed containers.
  • Separate containment for firearms, ammunition, jewelry, money, narcotics, paraphernalia, and other evidence.
  • Items that may contaminate each other are packaged separately.
  • Syringes are sealed in Department-approved sharps tubes with bio-hazard stickers.
  • Cell phones are packaged individually.
  • Multiple containers for large items.
  • Tags/labels for large evidence items.
  • Evidence bags are stapled and sealed with initials and date.
  • Envelopes use gummed flaps.

Large Evidence/Property Storage Procedures

  • Evidence custodians handle large items during normal hours.
  • Crime scene investigators or evidence vault supervisors handle items during off-duty hours.

Evidence Vault Procedures

  • Daily evidence inspections occur at 0800 hours, Monday-Thursday, to ensure proper packaging, sealing, and descriptions.
  • No property is accepted without proper packaging, sealing, and signatures.

Firearms Surrender Under Court Order Procedures

  • Firearms surrendered by court order are accepted by officers or CCSO.
  • Form 20.146, "NLVPD Vehicle or Property Release", outlines details.
  • A report is created in P1 to identify the item as EPO and include a property page.
  • Items are classified as seized or impound.
  • Receiving officer has the individual who is surrendering the items sign the form for a record.

9.10.01 – BLOODBORNE PATHOGENS

No bloody or possibly infectious clothing, materials, or property to be booked into evidence,

can be taken into ANY area of the Police Department except the Bloodborne Pathogens

Room, located at the Crime Scene Investigations Bureau (CSI), 2300 Civic Center Drive.

When collecting evidence/property in the field that may be infectious, always follow

Universal Precautions (see Procedure Chapter 11.65.01, Communicable Diseases/Bloodborne

Pathogens/Definitions). Place all items in a red plastic biohazard bag for transporting.

Upon arrival at the Bloodborne Pathogens Room, the following steps must be taken when

booking evidence/property.

Evidence/Property that is wet/bloody:

· Completely fill out the appropriate evidence package/container.

Sign chain of custody.

· Prepare and initial evidence tape.

· Affix a biohazard label on the outside of the evidence package/container.

use of Personal Protective Equipment (PPE) will be utilized as appropriate to the evidence

being processed:

➢ Gown/Bunny Suit

➢ Goggle/Face Shield

➢ Foot Covering (bootie)

· Select the required number of clean hangers from the supply cabinet.

· Take the evidence/property into the locker area (inner room).

tape, on top of the locker you will be using.

· Place butcher paper inside the bottom of the locker to assist with clean up.

· Hang the evidence/property on a clean hanger and place it in the selected locker.

· Secure the locker, using the supplied padlock.

· Exit the locker room area and remove the PPE.

· Dispose of used PPE and the red biohazard bag used to transport the evidence/property

in the appropriately marked biohazard waste container.

· Use the sink to wash hands and arms thoroughly.

·

Fill out the Evidence log (located on the wall next to the locker area door). Note the

following:

➢ Legibly print your name and serial number.

➢ Enter the locker number used.

➢ Enter the date the evidence/property was booked

➢ Enter the case number.

Evidence/Property with dried substances:

· Enter the Bloodborne Pathogens Room.

· Completely fill out the appropriate evidence package/container.

·

Sign chain of custody.

· Prepare and initial evidence tape.

· Affix a biohazard label on the outside of the evidence package/container.

· Dispose of used PPE and the red biohazard bag used to transport the evidence/property

in the appropriately marked biohazard waste container.

· Use the sink to wash hands and arms thoroughly.

· Take the evidence/property to the Evidence Vault for booking. Deposit the

evidence/property in the temporary evidence lockers at SAC/NWAC if the Evidence Vault

is closed.

9.15.01 – CHAIN OF CUSTODY

Chain of custody is the means by which we protect the integrity of evidence by providing

proof of every person who has handled it, and that these persons have the authority to

handle it, thereby providing proof that it has not been tampered with or altered.

A chain of custody is the combination of documented links between the moment a piece of

evidence is seized and when it is offered into evidence at trial. These links are the officers

and others who handled the evidence and the times, places, and purposes of the handling.

An officer must be able to go into a court of law, recognize the evidence (by the label or

tag), and be able to prove that the evidence is in the same or substantially the same

condition as when it was seized.

When a physical transfer of location occurs of any item of property, a record will be made

reflecting the transfer. The chain of custody shall be maintained by the following means:

·

Limit the number of individuals required to handle the evidence or evidence packages

from the time it is found to the time it is presented in court.

·

If the evidence must leave the possession of the Evidence Vault:

➢ The person to whom the evidence is given must have legitimate business handling it.

➢ The person to whom the evidence is given must sign the chain of custody on the

package face. The correct entries will be made in the property computer by the

Evidence Vault personnel.

➢ The person taking the item(s) will electronically sign the property tracking history.

➢ All package seals must be intact before the person is given the evidence package.

·

If the evidence must leave the possession of the booking officer before it is placed in the

vault, be sure to:

➢ Have all persons who handle the evidence sign the chain of custody.

·

If any personnel removes evidence from the vault other than for presentations to court, it

will be documented on a Fingerprint Comparison/Evidence Processing Report Form

(form 20.189) as to why the evidence was opened or removed. No property will be

released without a completed copy of a Fingerprint Comparison/Evidence Processing

Report Form.

If a CSI is requesting to remove evidence for processing at the request of a detective or

other officer, it will be documented on a Fingerprint Comparison/Evidence Processing

Report Form (form 20.189) and the Evidence Vault will be given a photocopy of the form

at the time any property is released for investigation. A report will be generated stating

why the evidence was checked out.

9.15.05 – RELEASING EVIDENCE FOR COURT

When an officer comes to the Evidence Vault to obtain evidence, it may be released if it is

for further investigation or other legitimate reason. The officer should have a subpoena for

the case if it is going to court.

The Evidence Custodian will pull packages from the vault and immediately enter the transfer

into the evidence computer including where the evidence has gone and to whom it was

released. Officers are to sign the chain of custody on each package and electronically into

the property computer record immediately upon receipt.

When officers are checking out evidence from the Evidence Vault, the Evidence Custodian

releasing and the officer receiving will check the evidence:

· To ensure that the proper chain of custody has been maintained.

· To ensure that the package shows no indication of tampering or unauthorized intrusion.

· To ensure that the package appears to contain exactly what is indicated on the package.

If the officer subsequently has occasion and purpose to enter the package, he will confirm

that the package contains exactly what is indicated on the package.

If evidence is retained by the court, the officer who checked it out shall bring back the

Evidence Transfer Receipt (form 20.143), signed and filled out by the court official taking

possession. The completed card is brought back to the Evidence Vault and given to the

Evidence Custodian. The Court maintains the evidence it keeps until the judicial process is

complete at which time it is returned to our Department.

When the package(s) return from court, the officer will return evidence directly to Vault

personnel. If after hours, the items shall be secured in an evidence locker. The Evidence

Custodian will sign the package(s) and return all items to their proper place in the vault.

The appropriate entries will be made in the property computer immediately upon return of

the evidence.

All evidence or the Evidence Transfer Receipt for the evidence shall be returned to the

Evidence Vault by the end of the day they were taken.

9.15.10 – EVIDENCE DISPOSITION

When a case is submitted to the Assistant United States Attorney for federal prosecution, the

officer or detective submitting the case shall:

·

Immediately notify an Evidence Custodian of the case number and status via e-mail.

· The submitting officer shall make certain that he/she has received an acknowledgment

from the Evidence Vault that the Evidence Custodian has received the notice of

submission and has flagged the case in the Evidence Vault files. If a response is not

received within five working days, a reminder shall be sent to the Evidence Vault

Supervisor.

Criminal cases are submitted to Municipal Court, Justice Court, District Court, and Federal

Court. Some cases go to more than one court. When a denial is received or a case is deemed

closed for the purpose of any future or immediate action, the investigator will notify an

Evidence Custodian, via e-mail or a Property Disposition form, that the case has been closed

and will not be pursued, and that either:

· The evidence must be held until the statute of limitations for that case has run out; OR

· The evidence can be disposed of, giving specific instructions for each item as to what

action to take and to whom items may be released.

The investigation officer closing the case shall enter a follow-up report stating why the case

was closed, and if applicable, that a property disposition was forwarded to the Evidence

Vault.

The following persons are authorized to make the determination on property dispositions:

· Officers/detectives assigned to an investigative detail;

· Sergeants assigned to an investigative detail;

·

Lieutenants or designees assigned to an investigative detail. The Evidence Vault

Supervisor is advised, via memo, of the appointed designee;

· Evidence Custodians and Senior Evidence Custodians.

Note: Evidence in homicides is never destroyed or cleared.

9.20.01 LABORATORY SUBMISSIONS

Narcotics Analysis

With exception of blood testing in DUI or traffic collision cases, authorization for processing

must be initiated by a detective, narcotics officer or higher authority, or by the office of the

District Attorney or City Attorney. The request will be on the designated lab or Metropolitan

Police Department (Metro) processing form.

Following receipt of a properly completed request form, evidence for which narcotics

analysis has been requested will be transported to the LVMPD Evidence Vault on the weekly

run by NLV Evidence Custodians.

Personnel at the receiving facility will document the receipt of the evidence and store any

perishable items in refrigerated sections until all items are tested and picked up by Evidence

Vault personnel. The lab chemist who does the individual test will sign chain of custody,

including the date and time, upon proceeding with the tests.

While at the LVMPD Evidence Vault, the Evidence Custodians will pickup any evidence for

which analysis has been completed. Upon return, they will book it back into the NLV

Evidence Vault making appropriate entries into the Evidence computer with electronic

signature and signing the chain of custody each time.

If any affidavits accompany the returned evidence, the affidavits will be given directly to the

Office Assistant to the Detective Bureau.

Whenever handling and transporting evidence, the packages should be examined to make

sure the evidence is secure and seals are intact before taking receipt and signing the chain

of custody.

Live Blood Samples

Requests for processing for the presence of alcohol or drugs in blood may come from the

booking officer in addition to the individuals called out in the first paragraph of this

subsection.

Blood Collection Kits will be deposited in the secure refrigerator in the evidence booking

room designated for this purpose at SAC or NWAC. Requests for processing blood samples

will be made by attaching a properly completed Toxicology Request Form to the Blood

Collection Kit with a rubber band.

Only Blood Collection Kits that have been properly packaged will be accepted for booking

into evidence. Each used collection vial will be sealed with one piece of signed and dated red

evidence tape (supplied with the Blood Collection Kit). Each Blood Collection Kit will be

sealed with one piece of Department supplied evidence tape. The Blood Collection Kit box

label will be properly completed, including the signature of the nurse collecting the sample.

The completed Laboratory Request form will be attached to the box with a rubber band.

Any fresh blood, urine, or any other biological tissues or perishable materials will be

preserved and either refrigerated or frozen, appropriate to its individual characteristics, until

just prior to transportation.

Any evidence of a perishable or sensitive nature will be stored as stated above, within the

Evidence Vault storage areas until such time as standards can be collected or until an

appropriate testing method is determined.

Medical personnel will take no blood by force. Should a blood sample be necessary, a court

order may be obtained.

SUBJECT: LABORATORY SUBMISSIONS

The NLVCCC will call the designated lab for all supplies. When down to approximately 10

kits, the lab will deliver the kit materials.

In addition to the above analyses, the Metropolitan Police Department will still be utilized for

various testing (firearms, handwriting, etc.). These tests must be requested by a Detective,

Detective supervisor, Narcotics Officer, or CSI supervisor. The following information must be

filled in or checked off on the LVMPD form in order for it to be accepted:

· Name of requesting officer and requesting bureau.

· Date of request.

· Booking officer's name, if different from requesting officer.

· Department telephone number.

· Type of incident.

· Submitting agency initials.

· Suspect and, if applicable, victims' name(s).

· DR# which is our case number.

· Type of test requested and type of material submitted.

This form serves as a written request for an affidavit. A LVMPD Evidence Log Sheet must be

submitted along with the request form. Evidence Vault personnel will transport the evidence

for testing, along with the LVMPD processing form.

Laboratory Submissions to Out-of-State Agencies

On occasion, circumstances will require that laboratory processing will be necessary which

cannot be done locally. In these instances, the evidence must be submitted to the FBI or to

the ATF, with the exception of gunshot residue (GSR) testing as outlined below.

Requests for testing by the FBI or ATF will come from the Detective Bureau or from the

District Attorney. The Crime Scene Investigator who handled the crime scene in question will

prepare and process these requests as follows:

· CSI will ensure that the Evidence Custodian pulls the evidence, and makes the

appropriate entries in the evidence computer. The CSI will then package the evidence for

mailing in a manner appropriate to the preservation of the particular material involved.

· The request for testing will include a synopsis of the incident which will give:

➢ Type of examination desired;

➢ Requesting officer's name;

➢ Brief description of the incident and how it occurred;

➢ Suspect and victim name;

➢ List of items of evidence submitted.

· A form letter directed to the appropriate agency will be prepared, giving our case

number, type of crime, and victim and suspect names. CSI will make five copies of this

letter and distribute as follows:

➢ Original to FBI/ATF in separate envelope;

➢ One copy contained within the package;

➢ One copy enveloped and attached to the outside of the package;

➢ One copy to Detective Bureau;

➢ One copy to CSI Bureau supervisor;

➢ One copy to Crime Scene Investigator;

➢ One copy to Records Bureau files.

➢ The package containing the evidence will be mailed first class, return receipt requested.

The case number will be written on the mailing receipt and return card.

· Returned evidence examination reports are routed as follows:

· One copy to Records Bureau files;

· One copy to Detective Bureau;

· One copy to CSI Bureau supervisor;

Gun Shot Residue (GSR)

Testing for GSR is conducted by Bexar County Laboratory. Requests for GSR testing must

come from the Detective Bureau, CSI Bureau, or from the District Attorney and must be

made on Bexar County Laboratory forms. Completed forms will be submitted to the

Evidence Vault. An Evidence Custodian will remove the evidence from the vault and, after

making appropriate entries in the Evidence Management computer, will mail the pre-

packaged GSR test kit, first class return receipt requested, to the Bexar County Laboratory.

Results of the test will be mailed directly to the individual requesting the test. The Bexar

County Laboratory will mail the sealed evidence package directly to the Evidence Vault

where the computer entry will be updated to show its return and it will be returned to

storage in the Evidence Vault.

9.25.01 – FINGERPRINT COMPARISON REQUESTS

The CSI Bureau will conduct process requests including fingerprint comparisons only upon

receipt of a completed Fingerprint Comparison/Process Request Form (form 20.189). The

first two sections of the form (e.g., case number, date, requested by, phone number) must be

completed by the requesting officer.

Upon completion of the examination, the CSI will complete the bottom section of the

request form. In cases of urgency, the CSI will contact the requesting officer by phone.

The CSI will then send a copy of the process request back to the requesting officer noting

any findings, positive or negative. The CSI will complete a follow-up report to all relevant

cases indicating findings, whether positive or negative.

Notify CSI that fingerprints are needed to obtain a positive identification. CSI will roll a set of

fingerprints and enter them into ABIS (Automated Biometric Identification System) first. If

CSI does not obtain a positive identity, then CSI will fax the fingerprints to the FBI with as

much information as possible.

Once a name, date of birth, state ID# (SID) or FBI# has been determined by CSI or Records, a

query will be run by CSI or Records through JLINK. CSI staff will notify the requesting person

about positive identification and complete an information report.

9.25.05 – FIELD PROCESS REQUESTS

Patrol Officers

A Fingerprint Comparison/Process Request Form (form 20.189) will be completed when

requesting processing work from CSI Bureau personnel. One of the following sections will be

completed: Process Request section or Photography section. The “remarks” section will be

used to explain pertinent details or to request work not specifically listed.

Submit this request with the report and list this as an attachment. The patrol supervisor

must sign the form. Their P# must be included. The canary and pink copies go to the CSI

Bureau Supervisor.

After the processing has been completed, the CSI will fill out the bottom portion of the form

with date completed, CSI name and P#.

All field requests for crime scene/evidence processing in which a CSI is/was unavailable,

must be submitted to, and approved by, the field supervisor. On minor crime scenes, with no

evidence requiring skilled CSIs, the officer may collect the evidence after documenting the

location and photographing the evidence in relation to the overall scene. The evidence will

be booked into the evidence facility. On more complicated scenes, field supervisors shall

consider the following factors when making the decision to leave a crime scene unattended

for later processing:

· The gravity;

· The victim’s request for processing;

· The possibility of viable evidence contained within the crime scene;

· The preservation and security of evidence; and

· Personnel availability.

If the scene is incapable of being secured until the arrival of a CSI, the field supervisor may

assign an officer to stand by until a CSI is available to respond to the scene.

Detectives

Detectives investigating cases where processing work needs to be completed will fill out the

request form for the appropriate processing requests. No evidence from a major crime

scene will be processed without a process request form from the lead detective handling the

case.

Requests for fiber comparisons, ballistics, controlled substance, drug screen, blood alcohol,

semen, and DNA will be sent to outside agencies and will need the applicable requests

attached. Example: Lab form.

Investigating detectives will not submit this form when outside agency processing requests

are needed. Example: LVMPD processing work will be requested on their appropriate forms.

CSIs will complete a process request when performing processing at the request of an

outside agency. This completed form will then be submitted to the CSI Bureau supervisor for

approval.

9.30.01 – VEHICLE OR PROPERTY FIELD RELEASES

When releasing a vehicle or property or seizing property in the field, the reporting officer(s)

are to use a Vehicle or Property Field Release Form (form 20.146).

This form is to be utilized for impounding and/or release of vehicles or property and should

not be used to report stolen vehicles or property.

The form consists of two copies, each having assigned requirements within the reporting

and record-keeping function.

· The original or white copy, once completed, shall be routed to the Records Bureau.

· The second or yellow copy shall be utilized as a receipt for the towing company agent, or

the owner or person in control of seized property.

The bottom portion of the form is used to write a short narrative regarding the use of the

form and/or describe property seized.

Example 1:

The driver of the above vehicle; Doe/John was arrested for DUI (Alcohol). Since no other

licensed driver was available to take custody of the vehicle, the vehicle was impounded.

Example 2:

From: Doe/John DOB: 01/01/75 SS# 012-34-5678

1234 Wherever St. N. Las Vegas, NV 89030

One Remington, bolt action rifle, Model 700, Cal 30-06, Ser. # N123456

The short narrative advises the clerks processing the form what may have occurred and

protects the officer completing the form from liability.

When using the form to receipt for seized property, the officer will check the "OTHER" block

at the top of the form and write "Receipt" in the upper right corner.

Once the form is complete, leave the yellow copy with the owner or person in control of the

seized property.

SUBJECT: VEHICLE OR PROPERTY FIELD RELEASES

If CSI is impounding a vehicle in the vehicle bay pending a search warrant, CSI will complete

a vehicle page stating the location and reason for the impound. Once the vehicle has been

processed by CSI, the vehicle page must be pulled forward and state whether the hold is

lifted and which tow yard has custody of the vehicle or if it has been released to the owner.
