Study Notes

Inmate Program Assignments and Payments

  • Responsibilities: Institutional Head/District Director ensures programs, employment, and vocational opportunities are available and appropriate for offenders, with accommodations for disabilities. They also manage processes for inmate payments, program hours, and limit access to inmate information. The Assistant Warden/Associate District Director leads the Correctional Intervention Board that handles program assignments, terminations, and reviews for suspended offenders. The Manager, Programs manages program assignments, inmate employment, employment orientations, and pay reviews. Correctional Manager reviews pay recommendations. Chief, Health Services, Chief Psychologist, and Security Intelligence Officer provide input for employment applications. Inmate supervisors provide assessments, orientation, and monitor attendance. Parole Officers comment on employment applications. Correctional Officer II/Primary Worker gathers participation data and completes pay reviews.

  • Offender Expectations: Inmates actively participate in their Correctional Plans, including program assignments. They provide necessary information (CSC/SCC 0843) for employment applications.

  • Exclusions from Payment: Inmates excluded from payment include those working for an outside employer, housed in community correctional centres, provincial facilities (except on federal registries), in Indigenous community care, or receiving a maintenance allowance.

  • Program Assignment Scheduling: Weekend and holiday program assignments are only for essential, emergency, or exceptional program needs.

Inmate Payments

  • Payment Levels: Payment levels (A-D) are based on daily rates ($6.90 to $5.25) and allowances ($2.50). Inmates will be given a single payment level for multiple programs.

  • Daily Payment: Inmates are usually paid for up to 10 full days per payment period. Overtime calculations are based on 1/5th of the daily rate for every hour worked, only authorized when not possible to achieve the week's work hours via other means. Pro-rated payment is applied based on participation duration on active programme days.

  • Absence from Programmes: Inmates not participating in programs, or with authorized absences, usually receive a $2.50/day allowance. Special allowances for Indigenous inmates attending spiritual ceremonies are stipulated. No allowances for unauthorized absences or disciplinary/suspension periods up to 10 working days.

  • Refusal to Participate: Inmates refusing to participate in programs or to complete required paperwork (e.g., employment applications) will receive basic allowances on weekdays only; no weekend allowance.

Inmate Transfers and Movements

  • Transfers: Incoming inmates at other institutions will have their payment level based on prior levels or a new assigned level upon refusal of given programmes, and the receiving institution handles payment during transit.

Inmate Pay Reviews

  • Review Criteria: Pay levels are based on attendance, punctuality, program performance, Correctional Plan engagement, overall institutional behaviour, any security threat group affiliations, and time at the respective level.

  • Review Processes: Correctional Officer II/Primary Worker completes pay reviews (CSC/SCC 1138-1). Manager, Programs reviews and makes the final decision when concurring with the recommendations. The Correctional Intervention Board may be convened in certain circumstances like pay level "A" assignment, discrepancy in pay level, inmate contesting the pay decision, or the need for additional information.

Suspensions and Terminations

  • Suspension Reasons: Suspensions occur for absences without a reasonable excuse or refusal to participate. Informal approaches like behavioural contracts are preferred.

  • Suspension Procedures: Suspensions follow formal procedures involving the program/work supervisor, Parole Officer, Manager, Programs/Community Program Manager, and Correctional Intervention Board. This process will result in zero pay to the offender and will need approval to end the suspension.

  • Termination Reasons: Programs can be terminated if meaningful participation is deemed impossible (e.g., due to mental health or educational issues). The termination notice will include a new program assignment to be given within the same time frame. Inmate withdrawal requires 10-working day notice.

Segregation and Administrative Segregation

  • Segregation: Inmates in segregation for more than 7 days require a Correctional Intervention Board review within 12 working days. Disciplinary segregation includes a 10-day zero-pay period while in the unit. Administrative segregation reviews are handled on a case-by-case basis and consider contributions to the segregation and impact of the program suspension.

Maternity Leave

  • Maternity Leave: Leave can precede childbirth, with payment levels preserved, and participation in programs is optional.

  • Leave Duration: Fifteen weeks with pay of the prior level is applicable to Mother-Child Program participants, and six weeks to others with a follow-on nine-week period of adjusting back to the Correctional Plan and maintaining the prior level.

Inmate Injuries

  • Injury Reporting: Inmate injury reports (CSC/SCC 1397) and injury classifications (CSC/SCC 1375) are completed to document injuries and absences due to injury. Absent for injury during an assignment earns a $2.50 allowance.

Shutdowns

  • Shutdown Payments: Payments are contingent on whether inmate actions led to the shutdown. Partial or full days of payment will apply depending on participation or absence during the shutdown period.
