Convention on the Rights of the Child
- Child Definition: A child means every human being below the age of eighteen years, unless the applicable law of the child sets a different majority age.
- No Discrimination: States Parties must respect and ensure the rights in the Convention for every child within their jurisdiction without any discrimination based on race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status. Children should be protected from discrimination based on their parents' or family members' status, activities, opinions, or beliefs.
- Best Interests of the Child: In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities, or legislative bodies, the best interests of the child shall be a primary consideration.
- Protection and Care: States Parties must ensure that children receive protection and care necessary for their well-being, including consideration of the rights and duties of parents, legal guardians, or other legally responsible individuals.
- Protection of Institutions: Institutions responsible for children's care must conform to standards set by competent authorities, focusing on safety, health, and appropriate staffing numbers and supervision.
- Implementation of Rights: States Parties must take all necessary legislative, administrative, and other measures to implement the rights recognized in the present Convention; especially economic, social, and cultural rights, with available resources.
- Parental Responsibilities: States Parties must respect the responsibilities, rights, and duties of parents, legal guardians, or other legally responsible persons in guiding the child in exercising their rights, taking into consideration the evolving capacities of the child.
- Right to Life and Development: Every child has an inherent right to life. States Parties must ensure the survival and development of the child to the maximum extent possible.
- Registration and Identity: Children must have the right to be registered immediately after birth, receive a name, acquire nationality and, as far as possible, know and be cared for by their parents.
- Preservation of Identity: States must respect a child's right to preserve their identity, including nationality, name, and family relations. If a child is unlawfully deprived of this, appropriate assistance and protection is required for speedy restoration of their identity.
- Separation from Parents: A child should not be separated from their parents against their will except when a competent authority, subject to judicial review, determines, in accordance with applicable law and procedures, that the separation is necessary for the child's best interests.
- Maintenance of Relations: If a child is separated from a parent(s), the child should maintain regular contact with them unless against the child's best interest.
- No Discrimination: States Parties must respect the right of a child to not be subjected to arbitrary or unlawful interference with their privacy, family, home, or correspondence, or honor and reputation. They have the right to the protection of the law against any interference or attacks.
- Right to Information: Mass media should provide information that is beneficial for the child's well-being and there must be access to diverse national and international resources.
- Parental Duties: States Parties should recognize the joint parental responsibilities in the upbringing, care, and development of a child. The best interests of the child are paramount.
- Child's Right to Education: States Parties recognize a child's right to education and must strive for the provision of compulsory free primary education and encouragement of different forms of secondary and higher education, according to each child's needs and capacity. Education should be appropriate to the child's age and needs.
- Freedom of Thought: States Parties respect the right of the child for freedom of thought, conscience, and religion.
- Freedom of Association: States Parties recognize a child's right to freedom of association and peaceful assembly.
- Freedom of Expression: The child has the right to freedom of expression, including the right to seek, receive, and impart information and ideas.
- Protection from Exploitation: The child must be protected from economic exploitation and harmful work which may interfere with their education or harm their health or mental, physical, or moral development.
- Protection from Abuse: The child must be protected from all forms of sexual exploitation and abuse; measures must be taken by States Parties including national, bilateral, and multilateral measures to prevent the inducement or coercion of a child into unlawful sexual activity.
- Protection from Other Exploitation: States Parties shall take measures to protect the child from all forms of exploitation prejudicial to their welfare.
- Protection from Abuse: No child should be subjected to torture, cruel, inhuman, or degrading treatment, violence, injury, or abuse by any person responsible for care.
- Protection in Armed Conflict: States Parties must refrain from recruiting those below 15 years of age into armed forces, prioritize those above 15 and under 18 and protect children in armed conflicts.
- Recovery from Abuse: States must ensure recovery and reintegration take place in an environment which protects children's dignity.
- Right to Standard of Living: States Parties shall recognize every child’s right to a standard of living necessary for their physical, mental, spiritual, moral and social development. Provision of support for the child should be provided by the parents; but measures must be taken to assist families in need to fulfil these needs.
- Right to Benefit from Social Security: States must recognize a child’s right to benefit from social security including social insurance and measures must be taken so children achieve the full realization of this right.
- Right to Education: Education of the child should be directed to the full development of the child’s personality, talents and mental and physical abilities, respect for fundamental freedoms and principles
- Right to Rest and Leisure: States shall respect and promote the child’s right to participate fully in cultural and artistic life and encourage provision of appropriate and equal opportunities for leisure and recreational activity.
