Comprehensive Mental Health Act

The Comprehensive Mental Health Care Act of 2019 amended the existing Mental Health Care Act to improve mental health facilities across India. This revised legislation has been operational since October 2020.

Barriers to Implementation

State Level Challenges

At the state level, there is a lack of coordination between different departments responsible for implementing the Act. In many states, the Department of Social Welfare acts as the nodal agency, which may lead to delays and confusion in the implementation process. Additionally, limited awareness and lack of prioritization from the government further contribute to slow progress.

Funding Issues

There is also a lack of adequate funding for mental healthcare services. While the Ministry of Health and Family Welfare provides financial support through grants under the National Health Stack, these funds often do not reach the intended beneficiaries due to misappropriation and corruption within the system. Moreover, the pandemic has exacerbated this issue, with reduced budgets allocated for these programs.

Capacity Building

Mental healthcare providers require continuous training to stay updated with the latest treatments and interventions. However, the low remuneration offered to psychiatrists and other professionals makes it challenging to attract and retain skilled personnel in this field. Furthermore, weak infrastructure and the limited availability of equipment compound the problem.

Healthcare Providers

Healthcare providers must balance their responsibilities towards patients with the legal requirements set forth by the Act. For instance, ensuring confidentiality while reporting patient information can pose a challenge. Additionally, they must navigate complex procedures required under the Act, adding administrative burden to their already demanding roles.

Patients and Families

Many individuals seeking mental health treatment have limited resources to access care. They often struggle with stigma associated with mental illness, which prevents them from seeking help in the first place. In some cases, families may not acknowledge the presence of mental health issues in their loved ones, further delaying intervention.
