Child Abuse and Neglect Definitions
- Abuse: Non-accidental physical injury or emotional/mental damage to a child by a responsible party.
- Bodily Injury: Physical pain, illness, or any impairment of physical condition.
- Child: A person under 18 years of age who is not married or has not had their legal minority status removed.
- Child Protective Worker: DFPS staff member trained to investigate child abuse and handle legal actions.
- Court: District Court with jurisdiction over civil proceedings affecting the parent-child relationship.
- Designated Agency: Agency designated by the court to protect children and receive abuse reports.
- Emergency Removal: Removing a child from their home without parental consent before a court hearing due to immediate danger to their health or safety.
- Emotional Neglect: Failure of a parent or caretaker to provide for a child's developmental needs, such as stimulation and affection, and to provide consistent care.
- Exploitation: Forcing or unduly encouraging a child to participate in activities detrimental to their well-being. Examples include begging, stealing, exposure to immoral or degrading circumstances, inappropriate responsibilities for their age, and excessive working hours.

- Neglect: Depriving a child of minimally needed physical and emotional requirements for life, growth, and development by a person responsible for their health or welfare. Examples include inadequate housing, clothing, food, supervision, and medical attention, as well as abandonment.
- Serious Bodily Injury: Bodily injury that presents a substantial risk of death, causes death, leads to serious permanent disfigurement, or causes prolonged loss or impairment of bodily function.
- Sexual Abuse: Includes obscene or pornographic depiction of a child for commercial purposes, sexual assault, molestation, incest, prostitution, or other exploitation that harms or threatens a child's health or welfare.
- Suit Affecting the Parent-Child Relationship: A legal case concerning the appointment of a managing/possessory conservator, child access/support, or establishment/termination of the parent-child relationship.
Reporting Child Abuse and Neglect
- Patrol officers receive and investigate reports of child welfare issues.
- An investigator is notified to assist in the investigation.
- If contact is made with any person during the investigation, an offense report should be written and forwarded to DFPS.
- All child abuse and neglect offense reports will be forwarded to the Criminal Investigations Division.
Responding to Child Abuse and Neglect Reports
- Patrol officers and investigators respond to situations of child abuse or neglect when assigned or encountered.
- Responses are based on the level of injury, potential risk to the child, available social agencies, and community standards.
- If signs of non-critical child abuse are found:
- Attempt to speak with parents about concerns.
- Encourage parents to seek medical treatment for the child.
- Inform parents about community resources for child care.
- Advise parents about the criminal consequences of child abuse.
- Notify the Criminal Investigations Division.
Handling Child Neglect Reports
- If signs of child neglect are found (e.g., unsafe environment or lack of supervision):
- If no adult is available, notify a supervisor before entering the home.
- Attempt to locate the parents or responsible individuals.
- Arrange for temporary care within the home with responsible relatives or neighbors whenever possible.
- If no one is available to care for the child, contact the Criminal Investigations Division or DFPS for temporary care arrangements.
- Officers should observe and document details of the home for their report.
