Charitable Trusts
- A charitable trust must be for public purposes beneficial to the community or for the public welfare and be charitable within the 'spirit and intendment' of the Preamble to the English Statute of Charitable Uses 1601.
Key Characteristics
- A charitable trust must be beneficial to the community or of general public utility.
- If a purpose is shown to be beneficial to the community or of general public utility, it is prima facie charitable.
- The onus is on those who oppose its charitable status to show that the object is not within the 'spirit and intendment' of the Preamble.
Four Types of Approved Charity
- Trusts for the relief of poverty.
- Trusts for the advancement of education.
- Trusts for the advancement of religion.
- Trusts for other purposes beneficial to the community.
Benefits of Charitable Trusts
- Certainties of objects/Validity: No requirement for the objects of the trust to be certain.
- Tax advantage/Fiscal policy: Donors can enjoy tax exemption (charities are exempt from income tax).
- Rule against perpetuity: Charitable trusts are not subject to the perpetuity rule of 21 years.
