Study Notes

Reciprocity

  • A contractor from another state must obtain a California contractor's license before working as a contractor in California. The CSLB has formal reciprocity agreements with Arizona, Nevada, and Utah.
  • If you hold a valid contractor's license in one of these three states, the Registrar may choose to waive the trade exam only. To qualify for reciprocity, you must apply for a license in that classification, in good standing, for the previous five years.
  • A Request for Verification of License form must also be submitted to the CSLB.

Contractor's Bond

  • After passing the qualifying exams or having them waived, you will receive a letter entitled "REQUEST FOR BOND(S)/LICENSE FEE".
  • It will ask for two things: (1) the license fee and (2) a $15,000 contractor's bond or bond alternative (e.g., a $15,000 cashier's check).
  • The bond must be filed with the CSLB within 90 days of the effective date of the bond.
  • The bond is written in favor of the State of California and guarantees that the bonding (surety) company will pay for certain damages caused by the bonded contractor (the "principal") to third parties ("obligees" or "beneficiaries"—typically a homeowner or client).
  • The damages must have resulted directly from a violation of the Contractors' License Law.
  • The bond may protect: homeowners, persons damaged by a willful and deliberate violation of the Contractors' License Law or by fraud carried out in the course of a construction contract, employees who were not paid by the licensee, and trust funds to which a licensee failed to pay fringe benefits due as a result of a union collective-bargaining agreement.
  • The contractor's bond may not be used as a performance or payment bond.
  • If the funds are awarded to the claimant, the bonding company will pay the injured party but will then attempt to collect the funds from the principal (you).
  • A bond is significantly different from common (e.g., fire) insurance policies.
  • A contractor's license bond is usually purchased from a licensed insurance agent who represents a bonding company. Most bonding companies issue contractor's bonds for one-, two-, or three-year terms. The bond is valid until either its term expires, or it is replaced by a new bond.
