General Duties of Occupiers and Manufacturers in Factories

• Occupiers of factories are responsible for ensuring the health, safety, and welfare of all workers while they are at work.
• The duties of occupiers include providing and maintaining safe plant and systems of work, ensuring safety in the handling and storage of articles and substances, providing necessary information, instruction, training, and supervision, maintaining safe places of work, and providing a safe working environment.
• Occupiers must prepare a written statement of their general policy on health and safety and bring it to the notice of all workers.
• Manufacturers, designers, importers, and suppliers of articles for use in factories are responsible for ensuring that the article is safe and without risks to the health of workers when properly used.
• Manufacturers must carry out necessary tests and examinations and provide adequate information about the use and conditions necessary for safe use of the article.
• Importers of articles manufactured outside India must ensure that the article conforms to the same standards as those manufactured in India or higher standards if adopted in the country of manufacture.
• Manufacturers may carry out research to minimize risks to the health and safety of workers arising from the design or article.
• Manufacturers are not required to repeat tests, examinations, or research carried out by others if it is reasonable for them to rely on the results.
• The duties of manufacturers and designers extend only to things done in the course of business carried on by them and to matters within their control.
• If an article is supplied on the basis of a written undertaking by the user to take steps to ensure its safe use, the manufacturer is relieved of the duty to ensure its safety to the extent reasonable.
• An article is not considered to be properly used if it is used without regard to information or advice provided by the manufacturer.
• The term "article" includes plant and machinery for the purposes of this section.
