Apprenticeship Termination
- An apprenticeship ends with the completion of the final stage
- Apprenticeship can end early if the apprentice completes their obligations, or the employer has a valid reason
- The learner is entitled to a written notice that they are being terminated or released
- A probationary period is possible
- If a trainee is under 18 years old, the rules for termination differ
- A termination must be documented in a written format
- A termination of a contract must be justified by the reasons stated in the contract
- If the reasons outlined are not valid, the termination may be deemed unlawful
- The period of notice needs to be taken into account
- There is a clause for the compensation for damages that occurred to the company during the apprentice's time there
- In cases where reasons for termination are not made clear a penalty may be invoked
Release and Recoupment
- An apprentice may be released from their duties, under certain conditions
- Apprentices are allowed to leave their apprenticeship before the agreed date if they have reached sufficient and recognised qualification.
- The apprenticeship can only be terminated on certain circumstances or days, and not randomly
- There are maximum limits to the time a release or an absence can be carried out
- If an apprentice is released, there are procedures and regulations to go by to ensure the correct payments are made, and due process is followed
- Penalties may be invoked if releases are not made within the correct timeframes
Probation Period
- The probation period lasts for a maximum of four months
- The probationary period only applies to apprentices under a certain age
