Principles of Law

• Law enforcement is a governmental activity needed to prevent anarchy and enable members of the public to move freely in society.

Strategic Planning

• A multi-year plan/strategic plan is published every 3 years.
• The plan sets long-term goals and operational objectives.
• It includes anticipated workloads, personnel levels, and capital improvements.

Appearance and Grooming

• Uniforms and equipment:
  • No alterations without prior approval.
  • Specific guidelines for uniforms, including:
    • Class A uniform
    • Summer uniform
    • Casual uniform
  • No special unit identifiers allowed on uniforms.

Performance

• Deputies are expected to maintain a neat and professional appearance.
• No jeans, suspenders, or shashes are allowed.

Inclement Weather/Emergencies

• Authorized closing of MCSO facilities in cases of emergency.
• Essential personnel are required to work during authorized closures.
• Non-essential personnel may be sent home or required to use vacation or holiday leave.

Discipline

• Discipline is corrective rather than punitive.
• Terms to know:
  • Admin leave with pay
  • Admin leave without pay
  • Reckoning period
  • Zero tolerance for workplace violence
• A supervisor may be disciplined to a higher degree than a lesser rank.

Investigations

• All investigations of complaints of employee misconduct:
  • Must be filed on an Employee Misconduct Form (MCSO FM 87-008)
  • Will be conducted fairly and impartially
  • Will be completed before Гаррити is signed

Red Light Violations

• Minor, serious, and extreme violations:
  • Caused by slight negligence or carelessness
  • Caused by greater negligence or carelessness
  • Caused by driving in a reckless or irresponsible manner

Garrity/Admonition

• Statement from employee and evidence derived from the statement cannot be used against them in a criminal prosecution.

Emergency Notification

• Traditional function:

  • Notify next of kin in cases of death, injury, or serious illness
  • May be made by phone or computer message
  • Best handled in person

• Criteria for emergency notification:

  • Death of a person
  • Seriously injured
  • Seriously ill

• Procedures for emergency contact:

  • Follow the Emergency Police Dispatch (EPD) protocols
  • When next of kin notification:
    • Homicide/ In custody death/ Suicide/ Child death
    • Member of CID must be notified
    • CID may notify the Chaplain to respond and assist
    • Natural death
    • Handled by patrol
    • Every effort to make delivery in person
    • If by phone, must be approved by Lieutenant or higher### Death Notification

• Never make a death notification at the doorstep

• Gather all household members in a private area to inform them of the notification

• Arrange a meeting with the next of kin in a conference room or private area

• Offer to summon another family member or support if needed

• If the next of kin is elderly or alone, do not abandon them

• If no one is home, leave a business card to contact the MSO or family member

Notification to Other Agencies

• The Medical Examiner is notified on all homicides, suspicious deaths, and deaths where the deceased person's physician will not sign
• Notify other agencies, such as the Public Information Unit (PIO), on all deaths

Arrestee and Inmate Transport

• Utilize a designated vehicle for arrestee and inmate transport
• Check the vehicle before and after each shift and transport
• Ensure the child lock is engaged on the doors, and the rear outside door is locked
• Handcuff arrestees behind their back, and the window is locked
• Never open the rear window, and only open the front right window in extreme circumstances
• Limit the number of arrestees to three, and separate juveniles from adults
• Women should not be transported with men unless a specific split cage is used

Baker and Marchman Acts

• Do not transport individuals under the Baker and Marchman Acts
• These individuals should be transported by corrections transport

Professional Standards

• The receiving process for all complaints on alleged employee misconduct is categorized into:
  • Criminal investigation
  • Internal Affairs
  • Administrative complaint investigation
  • Inquiry
• Supervisors can suspend employees with pay for up to 24 hours
• Commanders can suspend employees with pay for up to 72 hours
• Investigations should be completed within 180 days
• Employees shall be informed of the nature of the investigation prior to the interview
• Everything is recorded, including recess periods
• Final reports of findings include exoneration, not sustained, unfounded, or closed without finding

Firearms and Less Lethal Procedures

• Deputies must qualify in firearms twice
• If they fail to qualify, their handgun will be taken and placed in a non-certified position
• Firearms on duty must be carried in a Level 3 special holster
• Plain clothes deputies can carry primary or secondary firearms
• Deputies in plain clothes with exposed firearms must display their MSO badge prominently
• Secondary handguns must be between .380 and .45 caliber, with a minimum of 2 inches
• Agency-issued shotguns should be fully loaded with 00 buckshot and a 12-gauge slug
• Patrolling rifles should be between 16 and 20 inches, with a maximum of 50 rounds of practice ammunition per month
• Deputies are responsible for taking reasonable precautions against theft and safety
• The Law Enforcement Officers Safety Act (LEOSA) allows qualified current and retired LEOs to carry concealed firearms in any jurisdiction in the United States
• Uniformed deputies should have at least two less lethal options on their belt at all times
• OC spray warning is required before use, and never sprayed in proximity to open flames, electrical devices, or cigarettes/cigars
