Washoe County Sheriff’s Office 701.2 Inmate Clothing-Property Control Introduction The Washoe County Detention Facility utilizes a uniform method of receiving, maintaining, storing, releasing, and auditing inmate clothing and property. Specifically, this procedure applies to those inmates who are unable to secure a release after completing the booking process. Additionally, this procedure covers property/clothing considered biohazards, exposure to transdermal drugs, parasite exposure, property released as evidence, etc. Purpose The Washoe County Sheriff’s Office will use a uniform method of receiving, maintaining, storing, and releasing all inmates’ clothing and property. Scope All Detention Personnel Definitions Biohazard A biological or chemical substance or situation which is dangerous to human beings and the environment. Ectoparasites A parasite that lives on the outside of its host rather than within the host’s body. Examples may include fleas, lice, bed bugs, scabies, etc. Procedure 1. Inventory of Inmate’s Clothing A. Upon a completed inventory search in the sally port, an Intake Deputy will inventory the inmate’s personal clothing and will enter the information into the Corrections Management System (CMS). B. All clothing identified as a biohazard will be placed into a red biohazard bag and labeled with the inmate’s name and property number. The biohazard bag will be delivered to the Property Clerk for immediate handling. 1. Upon initial search of clothing, clothing which has been exposed to fentanyl will be handled as follows: Deputies shall wear protective equipment and avoid any skin contact with the exposed clothing. Deputies will place exposed clothing in a marked biohazard bag. Deputies shall not put exposed clothing in a mesh property bag covered by a biohazard bag. When deputies have completed this process, they will take the biohazard property bag to Property, physically hand the bag to a Property Clerk, and advise them the clothing has been exposed to fentanyl. The Property Clerk will place the biohazard bag into a vacuum bag and seal it as soon as possible. Once the bag has been sealed it will be placed back into the appropriate mesh property bag where it will remain unopened. 3. Upon release of an inmate who has exposed clothing in their property, the releasing Deputy will not open the sealed bag. The inmate will receive donated clothes and be given their sealed exposed clothing. The inmate will not be allowed to open the fentanyl exposed clothing until off WCSO property. The releasing Deputy shall order the inmate not to open the sealed bag until off WCSO property. C. The Intake Deputy and the inmate will sign the Washoe County Sheriff’s Office Inmate Personal Property sheet, verifying inventory of clothing, money, and secured property. 2. Intake Inmate Clothing Change out/into Inmate Jumpsuits A. Directly following the search procedure in the sally port, the inmate will be escorted from the sally port to the Civil Protective Custody (CPC) shower stall. B. If an arrestee is uncooperative or overly intoxicated, they will be placed in a holding cell per the current SOP 701 Intake. C. Once the inmate is released from the holding cell, they will go through the clothing change out to jump suit procedure before being allowed into the Intake lobby. D. The Deputy will inform the inmate to step inside the shower area and remove all personal clothing. The Deputy will place the inmates’ personal clothing in the inmate’s property bag. The Deputy will provide the inmate Detention Facility undergarments, to include socks and a jump suit (Green/White for Males and Blue/White for Females). E. Additional holding cells may also be utilized to change out inmates. Deputies may utilize the Property shower stalls if necessary. The Deputy will ensure there is a cover over the windows of the holding cells. (I.E., CPC Holding Cells 14/15, Intake holding cells if utilized) F. The Deputy will conduct a visual inspection of the area utilized for the change out procedure prior to moving the inmate. G. The inmate will be escorted to the body scanner for a full body scan before being directed to the Intake lobby. H. The inmate’s personal clothing will be searched for contraband by a Deputy and placed in the inmate’s property bag. Inmates Unable to Secure Release from Intake A. If an inmate is unable to secure a release after the Booking process, the inmate will be changed out of the jumpsuit in the Property shower stalls, and the jumpsuit will be given to Property for proper washing and reintegration back into the jumpsuit supply in Intake. 4. Inmates Able to Secure Release from Intake A. If an inmate can post bail or receives a release of his/her own recognizance, the inmate will be escorted to the Release change out stalls in the Release hallway. The Deputy will provide the inmate with their property bag and instruct the inmate to change back into their personal clothing. The inmate will be instructed to put the jumpsuit in the laundry bin, where the jumpsuit will be washed and reintegrated back into the jumpsuit supply in Intake. 5. Change Out and Decontamination Shower A. A property slip is completed by the Deputy which identifies the inmate’s name, booking number, property number and clothing sizes. The property slip is obtained by the Property Clerk at Station 2 or is given to the Property Clerk by the Deputy. B. The Deputy will obtain the Inmate Movement Card, in doing so, verifies the inmate’s name has been removed from the Station 2 Lobby Count. The Deputy will verify all CMS event entries have been completed. The Deputy will escort the inmate(s) to the shower stalls located near Property. C. Inmates will be provided a decontamination shower prior to moving to their housing unit assignment. A Deputy of the same gender identity as the inmate’s gender identity will be utilized for this process. Transgender inmates shall be given the opportunity to shower separately from other inmates. (Reference SOP 704.11, Transgender and Gender-Variant Inmates, and 28 CFR § 115.42). Inmates deemed combative or uncooperative will forego the decontamination shower process. (Refer to Section 3 of this procedure.) D. Once the Deputy directs the inmate into one of the Shower/Changing stalls, the following will occur: 1. The inmate will be given instructions to remove all personal clothing and to place the clothing on the bench. 2. The Deputy will conduct a visual unclothed search of the inmate in the showers/changing stall. 3. The Deputy will retrieve the inmate’s personal clothing and place the clothing into the appropriate inmate’s property bag. The Deputy obtains the appropriate inmate uniform from the Property Clerk in accordance with the Uniform and Linen Issue Procedure and directs the inmate to dress in the uniform once the shower is completed. E. The inmate will not have access to the property bag without Deputy supervision. F. In all cases, when it is believed ectoparasites (e.g., bedbugs, fleas, scabies, lice) are present on the inmate, medical personnel will be notified, and the inmate will be evaluated and/or treated in accordance with the Medical Policy and Procedure Manual. 1. Upon confirmation from medical personnel ectoparasites are present, all clothing will be placed into a red biohazard bag. The bag will be tagged with the inmate’s name and property number. The bag will be forwarded to the Property Room with instructions for the item(s) being decontaminated in accordance with the established laundry procedures. 6. Combative/Uncooperative Inmates -- Decontamination Shower A. Any inmate that refuses to undress and shower in accordance with this procedure is processed in the following manner: 1. The inmate will be given ample opportunity to voluntarily remove and surrender their clothing prior to the initiation of clothing removal by Deputies. Deputies will re-evaluate the inmate’s demeanor throughout this process. Should the inmate begin to comply with Deputy directives, the inmate may be afforded the opportunity to remove their own clothing. 2. The Intake Sergeant can direct the appropriate number of deputies to physically complete the change out procedure, which includes removing the inmate’s personal clothing in the shower area. Should the Intake Sergeant not be present, Deputies should utilize a reasonable number of Deputies to accomplish the procedure safely. 3. Care will be taken not to injure the inmate or damage the inmate’s clothing. 4. Removal of the clothing will take place in an area where the inmate is shielded from the view of other inmates and uninvolved personnel. Removal of the clothing will be by deputies of the gender identity as the inmate. 5. At the discretion of the Intake Sergeant, deputies of the opposite gender identity of the inmate may assist provided there are not enough deputies of the same gender identity to complete the clothing removal. This will be the last reasonable option as it will be the responsibility of the Intake sergeant to evaluate personnel levels from other areas of the facility. Once an item(s) of clothing is removed, the deputies will begin to dress the inmate in the proper facility uniform and escort the inmate to the appropriate Administrative or Special Needs housing unit. 7. All necessary reports will be completed after the incident is completed. 7. Inmates with Physical Disabilities — Decontamination Shower A. Physically disabled inmates unable to utilize the shower facilities in Intake will be escorted to the Infirmary to utilize the handicapped shower facilities. B. The Deputy will obtain the inmate’s property bag and the proper inmate uniform from the property clerk prior to escorting the inmate to the Infirmary. C. In the Infirmary, the escorting Deputy will process the inmate in the same manner as inmates processed at the shower area of Intake to the extent their physical disability allows. D. If the escorting Deputy requires additional assistance, medical personnel will assist the Deputy in completing the procedure. E. The Deputy shall return the property bag containing the inmate’s personal clothing to the Property Clerk. F. Special clothing items required for medical conditions may be maintained by the inmate upon approval of medical personnel. The Deputy will search the item(s) and record the item(s) on the inmate’s property record form. G. Inmates requiring constant supervision and physical assistance during the use of the Infirmary handicapped shower facilities will remain in the Infirmary pending a housing assignment in accordance with SOP 701.3, Initial Housing Assignment Procedure. 8. Storage of Property A. The Intake Deputy will record the inmate’s property number, last name and at least the first initial of the inmate’s first name on the property bag. B. The property bag will be taken to property by the Property Clerk or Intake Deputy. The property bag is placed on designated rack(s) pending a release or housing unit assignment by the Property Clerk. C. Upon the inmate’s initial housing assignment, the Property Clerk will place the property bag on the designated rack numerically by the property number. If the Deputy or Property Clerk determines the inmate’s property is extremely odorous or ectoparasite infested, it will be processed in accordance with the laundry procedure prior to storage. 9. Security and Maintenance of Inmate Property A. The Property Clerk will maintain the inmate’s property in a safe and secure manner. B. Access to inmate property will be limited to: 1. Property Supervisor and Property Clerks 2. Intake Sergeant or designee. C. Inmate workers assigned to property room duties will be under the constant supervision of the Property Clerk. D. At no time will any inmate worker open, handle, or access any property bag(s) unless monitored by a Property Clerk or Deputy during the release process. E. At no time will inmate workers be left unattended in the property room. F. Intake Deputies should complete random walk-through/searches of the property room and assigned inmate workers at any time throughout the shift. 1. Inmate clothing is controlled by the Sheriff’s Office is subject to subsequent search or examination by Sheriff’s Office personnel for the purposes of safety and security, gathering intelligence, or locating items of evidentiary value while it is in WCSO’s custody. 10. Release of Inmate Property A. Inmate property may be released in accordance with a court order, when the inmate is released from custody, or to any law enforcement officer requesting the property as evidence. 1. Property released pursuant to a court order is processed by the Property Clerk as follows: a. The Property Clerk shall obtain a copy of the court order requesting the property. i. Remove the property requested in the court order. ii. Forward the receipt and court order to Booking for filing in the inmate’s booking jacket. When an inmate is being transferred to the Nevada Department of Corrections (NDOC), the following will occur: a. Upon sentencing in court to NDOC’s custody, an inmate will be required to release his secure and bulk property to a designated person via a smart communications tablet by filling out a Property/Money form. b. It is the inmate’s responsibility to have their property picked up before their transfer to NDOC. Bulk property will not be stored for longer than seventy-two hours after the inmate has transferred. Secured property will not be stored for longer than thirty days after transfer. The inmate shall be provided with this information. c. Any items not picked up in the approved time frames will be disposed of at the WCSO’s discretion. d. See SOP 702.4 Secured Property for the procedures to release property. 3. When an inmate is released from custody, the Deputy will: a. Escort the inmate to release hallway in accordance with the Release Procedure. b. Instruct the inmate to place all facility property including but not limited to cup, spork, blankets, sheets, books, tablets, and/or bin in the designated container. c. Direct the inmate into one of the changing rooms and instructs them to remove all facility clothing. d. Instruct the inmate to place all facility clothing into the designated container. e. Obtain the inmate’s personal property from the Property Clerk and give it to the inmate with instructions to get dressed. f. After the inmate is dressed, the Deputy instructs the inmate to place all facility clothing from the designated container into the soiled clothing container, conducting a visual inventory. g. Obtain any paperwork and direct the inmate to release window, continuing the release process. h. If the inmate has any excess bulk property stored in the Excess Bulk Property Storage (EBPS) room, the property clerk will retrieve it and place it into the property cage. The cage will remain locked except for the placing or removing of items. ii. Release the inmate’s personal and any bulk property using the Corrections Management System (CMS). 11. Property Taken as Evidence A. Property, including clothing items, may be taken as evidence when requested by a law enforcement officer investigating the inmate. 1. Clothing items requested during the Intake Procedure are processed as follows: a. Officer shall advise the Intake Deputy that the inmate’s clothing or specific clothing item(s) are being taken as evidence. b. Specific clothing items may be removed/obtained in the Booking Lobby and turned over to the arresting officer, so long as the inmate’s decency is maintained. c. The Officer receiving the clothing will complete a property receipt. The Officer will individually list all item(s) taken as evidence. The Officer will furnish the Intake Deputy with a copy of the receipt which will be placed into the inmate’s booking file. 2. Clothing which cannot be removed in the Booking Lobby will be removed in a holding cell or a stall at the Intake Shower Station. a. The arresting/transporting officer will enter the facility to be present and accept the property being taken as evidence. b. The Intake Deputy is required to remain with the inmate and the officer. c. The Intake Deputy will obtain the appropriate inmate uniform and replace the inmate’s personal clothing being taken as evidence. d. Upon completion of the process, the Intake Deputy will escort the inmate and officer to the Booking Lobby and advise Central Control to release the officer to the sally port, if necessary. e. The Intake Deputy will note the clothing taken as evidence onto the Inmate Personal Property form(s). The Intake Deputy and the inmate will both sign the Inmate Personal Property form(s), verifying the accuracy of the inventory. g. The Intake Deputy will forward the signed Inmate Personal Property form(s) and the property receipt to Booking. 3. Clothing and Bulk Property items requested for evidence after initial storage and processing. a. The Intake Deputy will obtain the inmate’s property from the Property Clerk. b. The Intake Deputy will take the inmate’s property and a property receipt to an appropriate viewing area. c. At no time will the Property Room be used as a viewing area. d. Property viewing areas will be selected to preserve the safety of the personnel, inmate(s) and the security of the facility. e. The Intake Deputy is required to always remain with the property. f. The Officer will be escorted to the viewing area by an Intake Deputy. g. The Officer will remove any or all property to be taken as evidence and complete a property receipt. The Officer will individually list all item(s) taken for evidentiary purposes. h. The Officer and evidence will be escorted out of the viewing area by the Intake Deputy. i. The Intake Deputy will return the remaining inmate property to the Property Clerk and the Property Receipt form to Booking. 12. Excess Bulk Property A. Acceptance 1. The Washoe County Detention Facility (WCDF) accepts for storage, an arrestee’s personal property which the arrestee can carry themselves, i.e., jackets, hats, purses etc. Any personal property more than this amount will be known as excess bulk property. Excess bulk property will be inventoried by the arresting/transporting agency and placed into the Excess Bulk Property Storage (EBPS) by the arresting/transporting officer. If a question arises as to what will be accepted and what will be stored in the EBPS, the Intake Sergeant will make the final decision. 3. Under no circumstances will property be accepted for storage which does not fit in the 17” X 12” X 16” bin. Any remaining property will be the responsibility of the arresting/transporting agency. B. Inventory 1. The arresting/transporting officer will inventory all excess bulk property in their possession and record the property on the Bulk Property Form. 2. The Bulk Property Forms are in the Booking Check in and Report Room. 3. The arresting/transporting officer will inventory the arrestee’s excess bulk property in the Booking Check in and Report Room excluding medical equipment i.e., wheelchairs, oxygen tanks can be inventoried in the parking lot and remain with the arrestee. 4. The arresting/transporting officer is not to conduct the inventory in the Intake Sallyport, as it impedes incoming arrestee’s and officers. The arresting/transporting officer will not put any unauthorized items in bulk property. 5. The arrestee may be present during the inventory. 6. Any money or valuable personal property such as jewelry found in the excess bulk property will be given to the Intake Deputy who will place it into the arrestee’s secured property. 7. The inmate and the arresting/transporting officer will sign the Bulk Property Form verifying the inventory. 8. If the inmate is unable to sign the Bulk Property Form, the arresting/transporting officer will indicate the reason on the signature line of the Bulk Property Form. 9. Property received without a suitable container will be placed into a plastic bag and put in the selected bin. 10. Any item discovered that is illegal by law to possess will be retained by the arresting officer and processed according to the arresting/transporting agency’s policy. 11. Perishable items will be disposed of in a trash bin. 12. Hazardous, flammable, poisonous, radioactive, or explosive items will not be stored in the EBPS. They must be taken by the arresting/transporting officer and stored at their agency in accordance with their agency’s policies and procedures. The arresting/transporting officer will complete the Bulk Property Form and place the white copy along with a completed identification tag on the bin. The remaining Bulk Property Forms will be turned into the Booking window (Station 1) to receive the key to the EBPS. 2. The arresting/transporting officer will take the property to the EBPS. The arresting officer is limited to one bin per inmate. 3. The arresting/transporting officer will place the bin in alphabetical order on the shelving in the EBPS. 4. The arresting/transporting officer will lock the door to the EBPS and return the EBPS key to Station 1. Arresting officers will not give the EBPS key or allow entrance to the EBPS to any other arresting agencies (including their own) until they have been processed through Station 1. 5. In the event the Bulk Property Form is not completed properly, to include the inventory of the arrestee’s items stored, the WCDF will not accept the bulk property. The matter will be referred to the Intake Sergeant. D. Overflow Excess Bulk Property 1. When the EBPS is full the arresting/transporting officer will store any excess bulk property at their agency in accordance with their agency’s policies and procedures. E. Excess Bulk Property Removed for Evidence 1. Any property removed by any agency for evidentiary purposes must be cleared by the Intake Sergeant. 2. The arresting/transporting officer will complete a Property Receipt listing all property removed. F. Disposition of Excess Bulk Property 1. The Property Clerk shall check the EBPS weekly to assure all bulk bins are in the proper alphabetical order. 2. The Property Clerk will not open or reach inside any bulk property. 3. When the EBPS becomes full and space cannot be made available, the Property Supervisor shall notify the user agencies the EBPS is full. As soon as space is available in the EBPS, the Property Supervisor will notify the user agencies. 13. Missing or Lost Property A. If an inmate claims to have missing property at time of release the following will occur: 1. The inventory is checked to verify if the property in question was or was not listed. 2. The Property Clerk will make every reasonable effort to locate the missing property. 3. If the property is not located, the Deputy will notify their Sergeant. 4. The Deputy will complete an incident report which shall include a completed statement from the inmate, the alleged property loss and inmate’s estimated value of lost property. 5. If the inmate refuses to complete a written statement, the Deputy shall attempt to obtain a Body Worn Camera recorded statement. This shall include all alleged lost items and the inmate’s estimated value of lost property. 6. The Deputy will provide the inmate with a copy of the Washoe County Risk Management Procedure for filing a claim. The Deputy will also explain NRS 197.160 Filing a False or Fraudulent Claim. 7. The Deputy will complete a Washoe County Liability & Property Loss Report Form. 14. Unclaimed/Non-Transferable Property A. Upon release of an inmate to another law enforcement agency, nonperishable personal property items which are not accepted by the other law enforcement agency will be disposed of in the following manner by choice of the inmate: 1. Released to a designated person; or 2. Disposed of by the Sheriff’s Office B. The inmate will submit an authorization for release of bulk/secure property in Smart Communications via a tablet prior to their transfer. C. If the property is not picked up by the designee within seventy-two hours after inmate transfer, the property will be disposed of. Property of monetary value not claimed within thirty days of the inmate transfer shall be turned over to the Booking/Central Supervisor for disposal or donated to charity. E. Unclaimed property with no monetary value shall be placed into the trash compactor at the detention refuse disposal area. F. Items not suitable for donation or are considered contraband, shall be placed into the trash compactor at the detention refuse disposal area. 15. Property Number Audits A. Property audits will be initiated by the Property Supervisor. B. The following is the procedure to ensure all property numbers are accounted for and duplicate numbers are not issued. C. Run a list “Master Alpha Roster Report” from Crystal Reports. D. Match each inmate’s property in the EBPS (Bulk Room) to your “Master Alpha Roster Report”. Log names not on the report. E. Check the names that are not on the list in Tiburon to verify the person has been released. F.
