Trade Mark Application Process
- After application, the examiner performs formalities and substantive examinations.
- If the application complies, it is published in the Trade Mark Journal.
- Anyone can oppose the registration during the opposition period.
- Oppositions based on absolute or relative grounds for refusal, mirroring the registrability criteria used during examination.
Absolute Grounds for Refusal of Registration
- Trade marks lacking distinctive character or consisting solely of signs designating kind, quality, quantity, intended purpose, value, geographical origin, time of production, or other characteristics of goods or services are prohibited.
Distinctive Character
- Even if individual components aren't inherently distinctive, the mark as a whole can achieve sufficient distinctiveness.
- Visual, aural, or conceptual similarity assessments should consider the overall impression, focusing on distinctive and dominant components.
- Similarity is a matter of impression, making it difficult to quantify.
Average Consumer Perspective
- The perspective of the average consumer, exercising reasonable care and good sense, is considered when assessing distinctiveness and similarity.
